RESOLUTION NO. 2013- 201'7 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br /> ISLES BEACH AUTHORIZING THE TERMINATION OF THE GRANT OF <br /> EASEMENT ACROSS CERTAIN REAL PROPERTY OWNED BY THE <br /> PINNACLE CONDOMINIUM ASSOCIATION, INC., (THE "ASSOCIATION") <br /> AND DESCRIBED IN EXHIBIT "A" ATTACHED HERETO (THE <br /> "EASEMENT PROPERTY"); AUTHORIZING THE MAYOR TO EXECUTE <br /> SAID TERMINATION AGREEMENT; AUTHORIZING THE CITY <br /> MANAGER AND CITY ATTORNEY TO DO ALL THINGS NECESSARY TO <br /> EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br /> DATE. <br /> WHEREAS, Aquamar 176, Inc., an inactive Florida corporation ("Aquamar"), was the <br /> developer of the Pinnacle Condominium as set forth in that certain Declaration of the Pinnacle <br /> Condominium recorded in Official Records Book 18334 at Page 990 of the Public Records of <br /> Miami-Dade County, Florida (the "Declaration"); and <br /> WHEREAS, Aquamar and its successor the Association granted the City a five (5) foot <br /> easement across certain real property owned by the Association and described on Exhibit "A" <br /> attached hereto (the "Easement Property"), for the purpose of public and pedestrian access, <br /> ingress and egress, over and across the Easement Property, which easement is recorded in <br /> Official Records Book 19016 at Page 826 of the Public Records of Miami-Dade County, Florida <br /> (the "Easement Agreement"); and <br /> WHEREAS, the Association has, as of even date herewith, entered into and recorded in <br /> the Public Records of Miami-Dade County, Florida, a Grant of Easement, whereby the <br /> Association granted to LPLA Partners, LP, commonly known as the Mansions of Acqualina, as <br /> grantee, a new easement over and across the Easement Property for access, ingress and egress <br /> ' between Collins Avenue and public beach(the "LPLA Easement"); and <br /> WHEREAS, LPLA Partners has granted to the City a seventeen foot (17) Emergency <br /> Beach Access Easement, inclusive of'the Easement Property, as a condition of the approval of <br /> the development project called Mansions of Acqualina; and <br /> WHEREAS,the City hereby consents to a termination of the Grant of Easement; and <br /> WHEREAS, this termination of the Grant of Easement is entered into for the purpose of <br /> setting forth upon the public record that the Grant of Easement is terminated, null and void and <br /> of no further force and effect. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA,AS FOLLOWS: <br /> Page 1 of 2 <br />
