June 11 2013 Hans Ottinot City Attorney City of Sunny Isles Beach 18070 Collins Avenue Sunny Isles Beach, Florida, FL 33160 Re: Mansiana Ocean Residences, L.L.C. - Permit Extension Notice Section 24 Ch. 2012-205, Laws of Florida, as amended by HB 7019 City of Sunny Isles Beach Building Permit Dear Mr. Ottinot: On behalf of Manisana Ocean Residences, L.L.C. ("Mansiana"), this serves as the requisite notice to the City of Sunny Isles Beach ("City") under section 24 of chapter 2012-205, Laws of Florida (See Exhibit"1"), as amended by HB 7019 (See Exhibit "2")to have Mansiana's City building permit extended accordingly. By way of background,the City issued a building permit to Mansiana in connection with Mansiana's development of the Solis project located at 15701 Collins Avenue,Sunny Isles Beach, Florida. By Letter Agreement dated August 26, 2009, Mansiana agreed to pay the City for outstanding building permit fees no later than August 26, 2011. (See Exhibit"3"). As referenced in City Resolution No. 2011-1768, by Court Order in a foreclosure action against Mansiana, Mercantil Commerce Bank, N.A., made payment of the outstanding building permit fees and the City was required to extend Mansiana's building permit expiration to August 28, 2013. (See Exhibit "4"). Section 24 of chapter 2012-205, Laws of Florida requires that building permits with an expiration date from January 1, 2012,through January 1, 2014 be extended for two years.The 2 year extension is addition to any existing legislative permit extension but is not to exceed 4 years in total. Subsection 3 of section 24 of chapter 2012-205, Laws of Florida previously provided: The holder of a valid permit or other authorization that is eligible for the 2-year extension must notify the authorizing agency in writing by December 31, 2012, identifying the specific authorization for which the holder intends to use the extension and the anticipated timeframe for acting on the authorization. The Florida Legislature recently passed HB 7019 which amends subsection (3) of section 24 of chapter 2012-205, Laws of Florida to read as follows: The holder of a valid permit or other authorization that is eligible for the 2-year extension must notify the authorizing agency in writing by October 1, 2013 December 31, 2012, identifying the specific authorization for which the holder intends to use the extension and the anticipated timeframe for acting on the authorization.
