Summary Minutes:Regular City Commission Meeting July 18,2013 City of Sunny Isles Beach,Florida <br /> Public Speakers: None <br /> Vice Mayor Aelion moved and Commissioner Gatto seconded a motion to approve the <br /> Resolution. Resolution No. 2013-2093 was adopted by a voice vote of 5-0 in favor. <br /> IOP. A Resolution of the City Commission of the City of Sunny Isles Beach,Florida,Approving a <br /> Request to Extend Building Permits Issued to Soloser, LLC as Assignee to Mansiana <br /> Ocean Residences, LLC for a Period of Two (2) Years Subject to Certain Conditions; <br /> Providing the City Manager and the City Attorney with the Authority To Do All things <br /> Necessary to Effectuate this Resolution; Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and City Attorney Ottinot reported noting that this <br /> request is based on two conditions: compliance with all terms and conditions imposed by the <br /> Building Official; and also, ensuring that the property complies with the City Code. There <br /> was another condition that he is withdrawing of making a voluntary park mitigation <br /> contribution of a minimum of$150,000 that the Dezer family will address at the Commission <br /> meeting in September, and so we will separate that condition. <br /> Public Speakers: Warren Stamm, Esq; Gil Dezer <br /> Warren Stamm, Esquire,on behalf of the Applicant, Soloser,LLC,for the project commonly <br /> known as the Solice, located at 15701 Collins Avenue. They are seeking a two-year <br /> extension of the existing Building Permit from its current expiration date of August 28,2013. <br /> This property is the subject of a foreclosure action with certain limitations that Soloser,as the <br /> owner and holder of the note and mortgage, must abide by until a final judgment of <br /> foreclosure is issued in favor of Soloser. We anticipate this matter will be heard by the Court <br /> within the next 60-90 days. The principal Gil Dezer said we are in the final hour of this <br /> situation with this foreclosure and we are looking for this extension to protect the values. <br /> Commissioner Scholl moved and Commissioner Gatto seconded a motion to approve the <br /> Resolution, as amended. Resolution No. 2013-2094 was adopted by a voice vote of 5-0 <br /> in favor. <br /> 10Q. A Resolution of the City Commission of the City of Sunny Isles Beach,Florida,Approving a <br /> Management Agreement for the Historical Newport Fishing Pier between the City of <br /> Sunny Isles Beach and American Federated Title Corporation,in Substantially the Same <br /> Form Attached Hereto as Exhibit"A"; Authorizing the Mayor to Execute Said Agreement; <br /> Authorizing the City Manager and the City Attorney to Do All Things Necessary to <br /> Effectuate this Resolution; Providing for An Effective Date. <br /> Action: City Clerk Hines read the title, and City Attorney Ottinot reported with this <br /> Agreement that Dr. Cornfeld and American Federated Title Corporation will be responsible <br /> for managing the Pier. City Attorney Ottinot read the conditions into the record noting that <br /> the City will be responsible for cleaning the Pier. He noted the language will be amended to <br /> add Commissioner Scholl's concern about the Bait Shop employee basically using the <br /> admission fees to pay his salary, and he and the City Manager will clarify that. <br /> Public Speakers: None <br /> 10 <br />
