CFN 2171480080026 <br />OR Bk 29013 Pss 1261 - 1263; (3P90 <br />RECORDED 01/31/2014 14:30:32 <br />HARVEY RUVINr CLERK OF COURT <br />MIAMI -DADE COUNTYF FLORIDA <br />RESOLUTION NO. 2013- gj_50 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA; AUTHORIZING THE <br />ASSIGNMENT OF TDRS IN THE ANIOUNT OF THIRTY THREE <br />THOUSAND THREE HUNDRED SIXTY FOUR (33,364) SQUARE <br />FEET OF FLOOR AREA AND ZERO (0) DWELLING UNITS TO <br />DEZER DEVELOPMENT LLC., FOR THE RECEIVING SITE <br />LOCATED AT 18080 COLLINS AVENUE; DIRECTING THE <br />ZONING ADMINISTRATOR OR DESIGNEE TO TRANSFER <br />THE TDRS FROM THE BANK ACCOUNT IN ACCORDANCE <br />WITH ZONING RESOLUTION I2,Z -I AUTHORIZING THE <br />ADJUSTMENT AND MODIFICATION OF THE TDR BANK <br />ACCOUNT; PROVIDING THE CITY MANAGER IVITH THE <br />AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, by Resolution No. 2011 -1795, adopted on November 9; 2011, the City <br />Commission approved the creation of the Private TDR sub - account bank in favor of Dezer <br />Development. LLC ( "Applicant') to facilitate the construction of a commercial office building; <br />and <br />WHEREAS, by Zoning Resolution No.13Z 138. adopted on October 17, 2013, the City <br />Commission approved the zoning application submitted by the Applicant and the request to <br />utilize TDRs in the amount of 33,364 square feet of floor area and 0 dwelling units; and <br />WHEREAS, the private TDR Bank balance will be adjusted to reflect the transfer of <br />Thirty Three Thousand Seven Hundred Fifty (33,750) and Sixteen (16) dwelling units: and <br />WHEREAS, the property receiving the TDRS is described as follows: <br />Parcel 1. Tracts A and B, of S.I.B. GOVERNMENT CENTER. according to the Plat thereof. as <br />recorded in Plat Book 168, Page 75 of the Public Records of Miami -Dade County, <br />Florida. "Also Known as': A portion of the Plat of S.I.B. GOVERNMENT CENTER, <br />according to the Plat thereof, as recorded in Plat Book 168, Page 75. of the Public <br />Records of Miami -Dade County; more particularly described as: All of Parcel 1, <br />LESS the North 150 feet, as measure along the East line thereof, and LESS the South <br />499.145 feet as measured along the East line thereof, of the REPLAT OF TRACT <br />"A" SUNNY ISLES SHORES SECTION A. according to the Plat thereof, recorded <br />in Plat Book 64, Page 74, of the Public Records of Miami -Dade County.
