RESOLUTION NO. 13-Z - tS% <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, ("CITY") APPROVING A SITE <br />PLAN APPLICATION (Z2013-02) SUBMITTED BY DEZER <br />UNIVERSAL, LLC (THE "APPLICANT") FOR THE PROJECT <br />ENTITLED "DEZER OFFICE TOWER" CONSISTING OF A 17 <br />STORY OFFICE/COMMERCIAL BUILDING WITH A TOTAL OF <br />146,250 SQUARE FEET OF FLOOR AREA RATIO ("FAR"); <br />PROVIDING THE CITY MANAGER AND THE CITY ATTORNEY <br />WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR <br />SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING <br />FOR AN EFFECTIVE DATE. <br />I. RECITALS <br />WHEREAS, Dezer Universal, LLC (the "Applicant") submitted a site plan application <br />(Z2013-02) to the City of Sunny Isles Beach, Florida, requesting the following: <br />1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting approval for a site plan for a 17 -story <br />office/commercial building with a total FAR of 146,250 square feet. <br />2. Pursuant to Section 265-23 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting to approve the utilization of TDRs from a <br />private TDR Bank account in the amount of 33,750 square feet of development rights <br />for the office/commercial building. <br />3. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit a north pedestal side <br />setback to be 5'-0", where a minimum of 10'-0" is required within the Business <br />Overlay District under Section 265-38 E.(5)(c) of the Land Development Regulations. <br />4. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit a south pedestal side <br />setback to be 5'- 0", where a minimum of 10'-0" is required within the Business <br />Overlay District under Section 265-38 E.(5)(c) of the Land Development Regulations. <br />5. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit a tower to be 124'-2" <br />from the front property line, where a minimum of 130'-0" from the front property line <br />is required within the Business Overlay under Section 265-38 E.(4)(d)[1 ] of the Land <br />Development Regulations. <br />6. Pursuant to Section 265-15 of the City of Sunny Isles Beach Land Development <br />Regulations, the Applicant is requesting a variance to permit a penthouse to be 201'- <br />3" from the front property line, where a minimum of 230'-0" from the front property <br />line is required within the Business Overlay under Section 265-38 E.(4)(d)[I] of the <br />Land Development Regulations. <br />13-Z-13`ZDezer Office Tower I <br />
