ORDINANCE NO. 2014 - 1.4 4 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265 "ZONING" SECTION 265-35D(4) TO ADD SIDE YARD SETBACK RESTRICTIONS IN THE MIXED USE — RESORT (MU-R) DISTRICT FOR LOTS WITH FRONTAGE BETWEEN 211 FEET AND 299 FEET IN ORDER TO PROVIDE AN OPTION FOR DESIGN FLEXIBILITY; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the purpose of this Ordinance is to promote the public health, safety and welfare of the residents of the City of Sunny Isles Beach in the use and development standards for multi-family and hotel uses within the City which from time to time need to be clarified and adjusted; and WHEREAS, the City desires to provide options for design flexibility in side yard setbacks, for those existing lots or lots combined by unity of title that may range from 211 feet to 299 feet in frontage, in the Mixed Use —Resort (MU-R) District; and WHEREAS, the City has determined that in order to be allowed to opt for such design flexibility, the owner should provide support for the maintenance of adjacent beach access or streetscape improvements; and WHEREAS, the City Commission. acting as the City Local Planning Agency, pursuant to Section 57-2 of the City Code, reviewed and made recommendations regarding the proposed amendments to the City land development regulations. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 265. "Zoning", Section 265-35(D)(4) is amended to read as follows: § 265-35. Mixed Use - Resort District (MU-R). . . . .Site development standards. (4) Minimum setbacks.
