RESOLUTION NO. 2019- 2i 20 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, EXPRESSING SUPPORT FOR <br /> FLORIDA SENATE BILL 76 AND FLORIDA HOUSE BILL 107 <br /> WHICH WOULD PROHIBIT THE USE OF WIRELESS <br /> COMMUNICATIONS DEVICES WHILE DRIVING; URGING THE <br /> FLORIDA LEGISLATURE AND GOVERNOR RON DESANTIS TO <br /> SUPPORT AND APPROVE THE LEGISLATION; DIRECTING <br /> THE CITY CLERK TO DISTRIBUTE COPIES OF THIS <br /> RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, Senator Wilton Simpson has filed Senate Bill 76, with co-introducers <br /> Senators Passidomo, Hooper, Mayfield, Book, Rouson, Berman and Perry for consideration by the <br /> Florida Legislature, and Representatives Jackie Toledo and Emily Slosberg have filed House Bill <br /> 107 which would amend Chapter 316 of the Florida Statutes to prohibit a person from operating a <br /> motor vehicle while listening or talking on a wireless communications device for the purpose of <br /> voice interpersonal communication; and <br /> WHEREAS, these proposed revisions to Chapter 316 of the Florida Statutes will assist in <br /> preventing crashes related to the act of using a wireless communications device while driving a <br /> motor vehicle; and <br /> WHEREAS, these bills will also delete the provision requiring that enforcement be <br /> accomplished only as a secondary action; and <br /> WHEREAS, it is in the best interests of the public throughout the state of Florida that the <br /> Florida Legislature adopt the proposed Senate Bill 76 and House Bill 107. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Recitals. The foregoing"WHEREAS" clauses are hereby ratified and incorporated <br /> herein. <br /> Section 2. Support for Senate Bill 76 and House Bill 107. The City Commission hereby <br /> expresses support for Senate Bill 76 and House Bill 107 and urges the Florida Legislature to adopt <br /> and Governor Ron DeSantis to support and approve them. <br /> Section 3. Directions to the City Clerk. The City Clerk is directed to distribute copies of this <br /> Resolution to Senators Simpson, Passidomo, Hooper, Mayfield,Book, Rouson, Berman and Perry, <br /> Governor Ron DeSantis, the Speaker of the House of Representatives, the President of the Florida <br /> Senate,the Florida League of Cities, the Florida Association of Counties, the Florida City County <br /> Management Association, and the Miami-Dade County League of Cities. <br /> Page 1 of 2 <br /> Reso expressing support for SB 76 and HB 107 <br />
