Russo, City Manager <br /> DATE: 2/21/2019 <br /> Resolution Supporting Florida Senate Bill 76 and House <br /> Bill 107 to Amend Section 316 of the Florida State <br /> RE: Statutes Prohibiting the Use of Wireless <br /> Communications Devices While Operating a Motor <br /> Vehicle <br /> L. RECOMMENDATION: <br /> It is recommended that the City Commission approve the proposed <br /> Resolution supporting Florida Senate Bill 76 and Florida House Bill <br /> 107 to prohibit the use of wireless communications devices while <br /> operating a motor vehicle. <br /> REASONS: <br /> Based on the need to protect the safety and welfare of pedestrians, <br /> and particularly due to recent accidents that have taken place in the City, <br /> both Vice Mayor Svechin and Commissioner Lama separately <br /> approached me regarding their support for these bills. <br /> The proposed legislation will prohibit the use of wireless <br /> communications devices while operating a motor vehicle and will delete <br /> the provision requiring that enforcement be accomplished only as a <br /> secondary action, which will authorize law enforcement officers to stop <br /> motor vehicles and issue citations to persons who are using a wireless <br /> communications device while driving. <br /> Additionally,the proposed bills stipulate that only in the event of a crash <br /> resulting in death or personal injury, will a users billing records for a <br /> 158 <br />
