ORDINANCE NO. 2019- 53(.0 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING ORDINANCE NO. 2018-526; APPROVING BUDGET AMENDMENT NO. BA1819-01 TO THE CITY'S OPERATING AND CAPITAL IMPROVEMENT BUDGET FOR THE 2018-2019 FISCAL YEAR - GENERAL FUND, STREET MAINTENANCE & CONSTRUCTION FUND, BUILDING FUND, PUBLIC ART TRUST FUND, CAPITAL PROJECTS FUND, STORMWATER FUND AND STORMWATER CAPITAL FUND; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO • IMPLEMENT THE TERMS AND CONDITIONS OF THIS . ORDINANCE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with Sections 200.065 and 166.241, Florida Statutes and the City Charter, the City Commission adopted the Budget for Fiscal Year 2018-2019 (the "Budget") by Ordinance No. 2018-526; and WHEREAS, the City's Finance Director has determined a need to amend the Budget for: (1) unaudited fund balance carryovers from the prior fiscal year, (2) purchase order carryovers from the prior fiscal year, (3) transfers of Police/PBA Step plan raises effective 10/1/2018 from the Human Resources budget to the Police Department budget, (4) appropriation of$1.4 million from fund balance in capital projects, effectively accelerating the Utility Undergrounding project (originally slated for a future year), (5) recording individual capital project carryovers from 9/30/2018 to 10/1/2018, and (6) adding funds to capital projects to fund purchase order carryovers as of 10/1/2018; and WHEREAS, the City Commission has determined that it is necessary to amend the Budget, as set forth in Exhibit "A", based upon the review and analysis provided by the Finance Director. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Budget Amendment. The Budget for Fiscal Year 2018-2019 adopted by Ordinance No. 2018-526 is amended as Amendment No. BA1819-01 to reflect the revisions in Exhibit "A". All other terms and conditions of Ordinance No. 2018-526 not otherwise amended by this Ordinance shall remain in full force and effect. Section 3. Authorization of City Manager. The City Manager is hereby authorized to take all actions necessary to implement the terms and conditions of this Ordinance. Section 4. Effective Date.
