RESOLUTION NO. 2019 - 2950 <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY <br /> ISLES BEACH, FLORIDA, RESCINDING RESOLUTION NO. 2018-2890; <br /> APPROVING A SALE AND PURCHASE AGREEMENT AND RELATED <br /> EASEMENT AGREEMENTS BY AND BETWEEN WINSTON TOWERS 600 <br /> CONDOMINIUM ASSOCIATION, INC. AND THE CITY OF SUNNY ISLES <br /> BEACH FOR THE PROPERTY LOCATED AT 174 STREET AND COLLINS <br /> AVENUE, ATTACHED HERETO AS EXHIBITS "A", "B", "C", "D", AND "E"; <br /> AUTHORIZING THE MAYOR TO EXECUTE SAID SALE AND PURCHASE <br /> AGREEMENT AND RELATED EASEMENTS; AUTHORIZING THE CITY <br /> MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE <br /> TERMS OF THIS RESOLUTION; DIRECTING THE CITY CLERK TO <br /> RECORD SAID EASEMENT AGREEMENTS IN THE PUBLIC RECORDS OF <br /> MIAMI-DADE COUNTY; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, Winston Towers 600 Condominium Association, Inc. ("Winston Towers") is the <br /> owner of a certain property located at 174 Street and Collins Avenue, Sunny Isles Beach, Florida; and <br /> WHEREAS, the City desires to construct a Pedestrian Overpass Bridge on 174 Street to <br /> connect the west and east sides of Collins Avenue (the "Pedestrian Bridge"); and <br /> WHEREAS, the City negotiatedagreement with Winston Towers an a reement for purchase of <br /> certain property located on 174 Street and Collins Avenue and related easements necessary for <br /> construction of the bridge, and for, landscaping, sidewalk expansion and installation of utilities; and <br /> WHEREAS, the City Commission wishes to approve the Sale and Purchase Agreement for the <br /> property located at 174 Street and Collins Avenue, attached hereto as Exhibit"A"; and <br /> WHEREAS, the City Commission wishes to approve the Easement Agreements for sidewalk <br /> expansion, landscaping, installation of utilities, maintenance of the Pedestrian Bridge, attached here to <br /> as Exhibits "B", "C", "D", and "E". <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Rescind Resolution No. 2018-2890. Resolution No. 2018-2890 approving a Sale and <br /> Purchase Agreement and related Easement Agreements by and between Winston Towers 600 <br /> Condominium Association, Inc. and the City of Sunny Isles Beach for the property located at 174 <br /> Street and Collins Avenue, is hereby rescinded. <br /> Section 2. Approval of Sale and Purchase Agreement. The City Commission hereby approves the <br /> Sale and Purchase Agreement by and between Winston Towers 600 Condominium Association, Inc. <br /> and the City of Sunny Isles Beach for certain property legally described in Exhibit "A". <br /> Section 3. Approval of Related Easement Agreements. The City Commission hereby approves the <br /> Permanent Easement Agreement, Landscape and Pedestrian Use Easement Agreement, Utility <br /> Easement Agreement, and Temporary Construction Easement Agreement, and by and between <br /> 82019- WT 600— 174 St Pedestrian Bridge Agreements 1 <br />
