<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
<br />SUNNY ISLES BEACH, FLORIDA, RATIFYING A PAYMENT TO
<br />BEISWENGER, HOCH AND ASSOCIATES, INC. (BH &A), TO
<br />PROVIDE POST DESIGN SERVICES FOR THE SUNNY ISLES
<br />BEACH/NEWPORT FISHING PIER, IN AN AMOUNT NOT TO
<br />EXCEED NINE THOUSAND FIVE HUNDRED DOLLARS
<br />($9,500.00); AUTHORIZING THE CITY MANAGER TO DO ALL
<br />THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
<br />PROVIDING FOR AN EFFECTIVE DATE.
<br />WHEREAS, on March 17, 2011 via Resolution No. 2011 -1693, the City Commission
<br />ratified an Agreement with Beiswenger, Hoch and Associates to provide post design services for
<br />the Sunny Isles Beach Pier a/k/a Newport Fishing Pier located at 16701 Collins Avenue, in a total
<br />amount not to exceed Forty -One Thousand Dollars ($41,000.00); and
<br />WHEREAS, on May 10, 2012 via Resolution No. 2012 -1911, the City Commission
<br />approved the First Amendment to Agreement with Beiswenger, Hoch and Associates, Inc., to
<br />provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not
<br />to exceed Eleven Thousand Three Hundred Thirty -Seven Dollars and Fifty Cents ($11,337.50),
<br />for a total contract amount of Fifty -Two Thousand Three Hundred Thirty -Seven Dollars and
<br />Fifty Cents ($52,337.50); and
<br />WHEREAS, on June 21, 2012 via Resolution No. 2012 -1923, the City Commission
<br />approved the Second Amendment to Agreement with Beiswenger, Hoch and Associates, Inc.. to
<br />provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not
<br />to exceed Seven Thousand Three Hundred Ten Dollars ($7,310.00), bringing the total contract
<br />amount to Fifty -Nine Thousand Six Hundred Forty -Seven Dollars and Fifty Cents ($59,647.50);
<br />and
<br />WHEREAS, on May 16, 2013 via Resolution No. 2013 -2061, the City Commission
<br />approved the Third Amendment to Agreement with Beiswenger, Hoch and Associates, Inc. to
<br />provide post design services for the Sunny Isles Beach/Newport Fishing Pier, in an amount not to
<br />exceed Fourteen Thousand Two Hundred Fifty Dollars ($14,250.00), and an additional Seven
<br />Hundred Fifty Dollars ($750.00) for any incidentals that may come up for a total amount not to
<br />exceed Fifteen Thousand Dollars, ($15,000.00), attached hereto as Exhibit "A ", bringing the
<br />total amount of this contract to Seventy -Four Thousand Six Hundred Forty -Seven Dollars and
<br />Fifty Cents ($74,647.50); and
<br />WHEREAS, the City was in need of final post design services for project certification as
<br />required by Florida Building Code which was not included in the Contract with Beiswenger,
<br />Hoch and Associates; and
<br />WHEREAS, the City requested Beiswenger, Hoch and Associates to provide said
<br />services for the Sunny Isles Beach/Newport Fishing Pier to facilitate the opening of the Pier for
<br />public use and enjoyment, and paid them an amount not to exceed Nine Thousand Five Hundred
