ORDINANCE NO. 2014 - AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 62 "PURCHASING" SECTION 62-13 TO CLARIFY THAT PURCHASES MADE THROUGH INTERGOVERNMENTAL COOPERATIVE PURCHASING ARRANGEMENTS OR PURCHASING CONSORTIUMS ORGANIZED AS A CORPORATION NOT FOR PROFIT WHOSE MEMBERS ARE GOVERNMENTAL ENTITIES ARE PERMITTED PROVIDED THAT SUCH CONSORTIUMS PROVIDE FOR A COMPETITIVE PROCESS FOR THE SELECTON OF A VENDOR; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the purpose of Section 62-13 of the City Code is to provide for exemptions from competitive bidding procedures for certain contractual services and products; and WHEREAS, the City desires to amend Section 62-13 of the City Code to clarify that purchases made through intergovernmental cooperative purchasing arrangements or purchasing consortiums organized as a corporation not for profit whose members are governmental entities are permitted provided that such cooperative purchasing arrangements or consortiums provide for a competitive process to select a vendor. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendment. Chapter 62, "Purchasing", Section 62-13 of the City Code is amended to read as follows: § 62-13. Exemptions from competitive bidding. The following shall be exempt from the competitive bidding procedures outlined in this chapter: Purchases made through intergovernmental cooperative purchasing arrangements or purchasing consortiums organized as a corporation not for profit whose members are governmental entities provided that such cooperative purchasing arrangements or consortiums provide for a competitive process to select a vendor.
