B. Parcel B (Miami-Dade County Water and Sewer Facility). The land use <br /> designation in the Future Land Use Map of the property located at 350 Sunny <br /> Isles Beach Blvd, consisted of 1.22 acres, as more particularly set forth and <br /> legally described in Exhibit "A" and graphically depicted in composite Exhibit <br /> "B", attached hereto and made a part thereof, is changed from Mixed-Use <br /> Business to Community Facility. <br /> C. Parcel C (Gateway Park Parking Garage). The land use designation in the <br /> Future Land Use Map of the property located at 252 Sunny Isles Beach Blvd, <br /> consisted of 1.92 acres, as more particularly set forth and legally described in <br /> Exhibit "A" and graphically depicted in composite Exhibit "B", attached hereto <br /> and made a part thereof, is changed from Recreation and Open Space to <br /> Community Facility. <br /> D. Parcel D (Gateway Park). The land use designation in the Future Land Use <br /> Map of the property located at 151 Sunny Isles Beach Blvd, consisted of 1.74 <br /> acres, as more particularly set forth and legally described in Exhibit "A" and <br /> graphically depicted in composite Exhibit "B", attached hereto and made a part <br /> thereof, is changed from Mixed-Use Business to Recreation and Open Space. <br /> E. TOWN CENTER SOUTH DISTRICT. <br /> The area lying south of the centerline of westbound Sunny Isles Beach Boulevard <br /> (SR826), north of the Canal/Waterway located south of Sunny Isles Beach <br /> Boulevard, west of the centerline of Collins Ave. (AIA) and east of the <br /> Intracoastal Waterway. The proposed designation is from Town Center to Town <br /> Center South Overlay. <br /> F. TOWN CENTER NORTH DISTRICT. <br /> The area lying north of the centerline of westbound Sunny Isles Beach Boulevard <br /> (encompassing the remainder of the existing Town Center area), west of the <br /> centerline of Collins Ave. (A 1 A) and east of the Intracoastal waterway. Current <br /> underlying land uses within the district are to remain unchanged. The proposed <br /> designation is from Town Center to Town Center North Overlay. <br /> Section 3. Severability. If any section, subsection, clause or provision of this Ordinance is <br /> declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not <br /> be affected by such invalidity. <br /> Section 4. Repeal of Conflicting Provisions. All ordinances, or parts of ordinances in <br /> conflict herewith be, and the same, are hereby repealed. <br /> Section 5. Transmittal. The City Manager or designee is hereby directed to transmit the City <br /> of Sunny Isles Beach Future Land Use Map Amendments to the State Department of Economic <br /> Opportunity, pursuant to Chapter 163, Florida Statutes. <br /> Section 6. Effective Date. This Ordinance including the future land use map amendment <br /> • - ' - - • - - ' -- •-- • •- - - - .- shall become effective, if <br /> the amendment is not timely challenged, thirty-one (31) days after the state land planning agency <br /> notifies the local government that the plan amendment package is complete.
