<br /> <br />CITY OF SUNNY ISLES BEACH <br />CONTINUING PROFESSIONAL CONSULTING SERVICES (CCNA) <br />RFQ No. 20-07-01 <br />Erosion Control Line (ECL) <br />An Erosion Control Line (ECL) is a jurisdictional boundary established in beach renourishment project areas. It is a <br />statutory requirement for nourishment projects in Florida (Chapter 161.141 Florida Statutes). Once established, <br />the ECL defines the boundary between upland (private) property and the State lands. The Trustees of the Internal <br />Improvement Fund (TIIF) must approve the location of the ECL and its location must be guided by the Mean High <br />Water line. Where Erosion Control Lines exist, they are mapped and recorded in the Public Records of the County, <br />and generally effectively replace the Mean High Water line in terms of legal significance. Surveyors working near <br />shorelines must be knowledgeable of the Erosion Control Line and its impact on property boundaries. <br /> <br />Coastal Contruction Control Lines (CCCL) <br />Coastal Construction Control Lines (CCCL) define portions of beach/dune systems subject to severe fluctuations <br />based on 100 year storm surge, storm waves or other predictable weather conditions. They are established after <br />a comprehensive engineering study where it has been shown to be necessary to protect upland properties and to <br />control beach erosion. The CCCL does not define ownership, but is a critical line that must be considered when <br />development is contemplated near the shoreline. The CCCL, where it exists, is mapped and recorded in the Public <br />Records of the County. Surveyors working near shorelines must be competent in reconstructing the Coastal <br />Construction Control Line. <br /> <br />Horizontal Control Surveys <br />BE has an extensive history in the preparation of Horizontal Control Surveys. Under our current and prior contracts <br />with the Florida Department of Transportation, BE has prepared countless such surveys. <br />While the purpose may vary, typically a baseline is defined either mathematically or on the ground and provided <br />to the design team. Under our FDOT contracts, random horizontal control points are set, and using rapid static, <br />static, Real Time kinematic GPS and conventional surveying or a combination of these, the control monuments <br />are located and their positions are described with respect to the baseline. <br /> <br /> Surveying Expert Witness <br />While surveying and mapping skills are obviously important assets, <br />consultants should also be prepared to defend the City in court, <br />should the need arise. Court work is specialized: a good surveyor is <br />not always a good expert. One must be confident, possess <br />excellent communication skills, have some fundamental <br />understanding of the law, and know what to say and what not to <br />say. Being conscious of the courtroom also guides how we prepare <br />our surveys from the outset. <br /> <br />BE has recent successful experience testifying in both jury and non- <br />jury trials. BE has extensive experience in the preparation of Court Exhibits (we are currently assisting the FDOT <br />Districts 4 and 6 Legal Department as well as others on several matters). Surveys and Maps are not always the <br />best choice for conveying complex information in a simple manner. Using Adobe Illustrator, PowerPoint, and other <br />applications BE has honed it skills at making compelling color graphics for court over the course of many years. <br /> <br /> <br /> <br /> <br />16
