ARTICLE 11 <br />SEVERABILITY CLAUSE AND ZIPPER CLAUSE <br />Section 1. Should any provision of this collective bargaining agreement, or any part <br />thereof, be rendered or declared invalid by reason of any existing or subsequently enacted state <br />or federal law, or by any decree of a court of competent jurisdiction, all other articles and <br />sections of this Agreement shall remain in full force and effect for the duration of this <br />Agreement. The parties agree to immediately meet and confer concerning any invalidated <br />provision(s). <br />Section 2. The parties acknowledge that during the negotiations which resulted in this <br />Agreement, each had the unlimited right and opportunity to make demands and proposals with respect <br />to any subject or matter not removed by law from the area of collective bargaining and that the <br />understanding and agreement arrived at by the parties after the exercise of that right and <br />opportunity are set forth in this Agreement. Therefore, the City and the Union, for the life of this <br />Agreement, each voluntarily and unqualifiedly waives the right and each agrees that the other shall <br />not be obligated to bargain collectively with respect to any subject or matter referred to or covered <br />by this Agreement and with respect to any subject or matter not specifically referred to or covered in <br />this Agreement, even though such subject or matter may not have been within the knowledge and - <br />contemplation of either or both of the parties at the time they negotiated or signed this Agreement. <br />Except as provided by Article 12 hereof, this Agreement contains the entire Agreement of the <br />parties on all matters relative to wages, hours, terms and conditions of employment as well as all <br />other matters, which were or could have been negotiated prior to the execution of this <br />Agreement. This Section does not prohibit the parties from entering into negotiations <br />concerning the terms of a successor Agreement. <br />-12- <br />
