7.5.1 Defective work not remedied. <br />7.5.2 Claims filed or reasonable evidence indicating probable filing of claims by <br />other parties against Contractor or City because of Contractor's <br />performance. <br />7.5.3 Failure of Contractor to make payments properly to Subcontractors or for <br />material or labor. <br />7.5.4 Damage to another contractor not remedied. <br />7.5.5 Liquidated damages and costs incurred by Consultant for extended <br />construction administration, if applicable. <br />7.5.6 Failure of Contractor to provide any and all documents required by the <br />Contract Documents. <br />When the above grounds are removed or resolved satisfactory to the Project Manager, <br />payment shall be made in whole or in part. <br />7.6 The City shall make payment to the Contractor in accordance with the Florida <br />Prompt Payment Act, Section 218.70, Florida Statutes. <br />7.7 The City shall make payment to the Contractor through utilization of the City's P- <br />Card Program. <br />ARTICLE 8 — CONTRACTOR'S REPRESENTATIONS <br />In order to induce the City to enter into this Agreement, Contractor makes the following <br />representations upon which the City has relied: <br />8.1 Contractor is qualified in the field of public construction and in particular to <br />perform the Work and services set forth in this Agreement. <br />8.2 Contractor has visited the Work Site, has conducted extensive tests, <br />examinations and investigations and represents and warrants a thorough <br />familiarization with the nature and extent of the Contract Documents, the Work, <br />locality, soil conditions, moisture conditions and all year-round local weather and <br />climate conditions (past and present), and, in reliance on such tests, examination <br />and investigations conducted by Contractor and the Contractor's experts, has <br />determined that no conditions exist that would in any manner affect the Proposed <br />Price and that the Project can be completed for the Proposed Price submitted <br />within the Contract Time as defined in this Agreement. Furthermore, Contractor <br />warrants and confirms that it is totally familiar with, understands and obligates <br />Contractor to comply with all federal, state and local laws, ordinances, rules, <br />CAM 20-0192 <br />C-10 EXHIBIT 3 <br />Page 10 of 46 <br />
