RESOLUTION NO. 2020 - 31+f <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, RATIFYING THE "DECLARATION <br />OF A LOCAL EMERGENCY" IMPOSED BY THE CITY MANAGER ON <br />NOVEMBER 8, 2020 AND THE "TERMINATION OF A LOCAL <br />EMERGENCY" ISSUED ON NOVEMBER 10, 2020 DUE TO TROPICAL <br />STORM ETA; AUTHORIZING THE CITY MANAGER TO DO ALL <br />THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach faced dangerous conditions of sufficient <br />severity and magnitude to warrant coordinated local government action to prevent or alleviate the <br />damage, loss, hardship or suffering threatened or caused thereby; and <br />WHEREAS, Miami -Dade County Mayor Carlos A. Gimenez declared a State of <br />Emergency for Miami -Dade County due to the threat of impending Tropical Storm Eta; and <br />WHEREAS, Tropical Storm Eta caused a condition of peril of life and property <br />necessitating the proclamation of the existence of an emergency and in accordance with Chapter <br />29 of the City of Sunny Isles Beach Code, the City Manager declared a local emergency due to <br />Tropical Storm Eta; and <br />WHEREAS, the emergency dangers and threats of Tropical Storm Eta have passed, and <br />the City Manager of the City of Sunny Isles Beach has terminated the State of a Local <br />Emergency. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Confirmation of Declaration of a Local Emergency. The City Commission of the <br />City of Sunny Isles Beach hereby ratifies the "Declaration of a Local Emergency" imposed by the <br />City Manager on November 8, 2020, attached hereto as Exhibit "A". <br />Section 2. Confirmation of Termination of the State of Local Emergency. The City <br />Commission of the City of Sunny Isles Beach hereby ratifies the "Termination of a Local <br />Emergency" issued by the City Manager on November 10, 2020, attached hereto as Exhibit `B", <br />provided however this confirmation of termination shall not be construed as a limitation on the <br />City Manager's authority to declare a state of emergency at any date subsequent to this <br />resolution. <br />Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate the terms of this resolution. <br />Section 4. Effective Date.
