RESOLUTION NO.2021 - 3 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, APPROVING A SECOND <br />AMENDMENT TO THE AGREEMENT WITH HARDESTY & <br />HANOVER, LLP, FOR PEER REVIEW SERVICES FOR THE <br />PEDESTRIAN OVERPASS BRIDGE OVER COLLINS AVENUE AT 180TH <br />STREET, EXTENDING THE TERM OF THE AGREEMENT FOR AN <br />ADDITIONAL 365 DAYS, ATTACHED HERETO AS EXHIBIT "A"; <br />AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT; <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br />FOR AN EFFECTIVE DATE. <br />WHEREAS, the Florida Department of Transportation ("FDOT") requires an <br />independent peer review of pedestrian overpass bridges on State Roads to be conducted by a firm <br />selected from an FDOT pre -approved list; and <br />WHEREAS, on July 18th, 2019 via Resolution No. 2019-2965, the City Commission <br />approved an Agreement with Hardesty and Hannover, LLP ("Consultant") to provide <br />independent peer review services related to the pedestrian overpass bridge to be located over <br />Collins Avenue at 180th Street ("Services"), in an amount not to exceed $56,475.00; and <br />WHEREAS, on November 19th, 2020 via Resolution No. 2020-3139, the City <br />Commission approved a Second Amendment to the Agreement with the Consultant to provide <br />additional services not included in the original Scope of Work, in an amount not to exceed <br />$29,760.00, bringing the total contract amount not to exceed $86,235.00; and <br />WHEREAS, the Consultant submitted a request to extend the term of the Agreement for <br />an additional 365 days from the issuance of the Notice to Proceed; and <br />WHEREAS, the City Commission now wishes to approve a Second Amendment to the <br />Agreement with Hardesty & Hanover, LLP to provide independent peer review services for the <br />pedestrian overpass bridge to be located over Collins Avenue at 180th Street, extending the term <br />of the Agreement for an additional 365 days from the issuance of the Notice to Proceed, attached <br />hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of Second Amendment. The City Commission hereby approves a <br />Second Amendment to the Agreement with Hardesty & Hanover, LLP to provide independent <br />peer review services for the pedestrian overpass bridge to be located over Collins Avenue at 180th <br />Street, extending the term of the Agreement for an additional 365 days from the issuance of the <br />Notice to Proceed, attached hereto as Exhibit "A". <br />Section 2.
