RESOLUTION NO. 2021 - 3 I72 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE ISSUANCE OF PURCHASE ORDERS TO MWI CORPORATION, D/B/A MWI PUMPS, TO PROVIDE REPAIR SERVICES TO THE GOLDEN SHORES STORMWATER PUMP STATION, IN AN AMOUNT NOT TO EXCEED SEVENTY-FIVE THOUSAND FOUR HUNDRED NINETY-FIVE DOLLARS ($75,495.00); AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in 2020, the City experienced torrential downpours, causing severe flooding in the Golden Shores neighborhood ("Golden Shores"); and WHEREAS, the heavy rain caused an over exertion in the capacity of the water pumps located in the Golden Shores Stormwater Pump Station ("Pump Station"); and WHEREAS, city staff determined that the water pumps were in need of emergency repairs ("Services") to ensure proper drainage of Golden Shores and its vicinity; and WHEREAS, pursuant to section 62-13 (D) of the City's Code of Ordinances, the City Manager determined that the risk of damage to private and public property, as well as to infrastructure, that is caused by flooding, constitutes an emergency and necessitates immediate action by the City, and therefore, does not permit adequate time to utilize the competitive bidding process; and WHEREAS, on or about November 2020, the City Manager instructed staff to conduct a good faith review of available resources and negotiate a reasonable price with a qualified contractor to provide the desired Services; and WHEREAS, city staff determined that MWI Corporation, d/b/a MWI Pumps ("Contractor"), is qualified, willing, and able to perform the Services desired by the City; and WHEREAS, on November 18, 2020, the City Manager authorized the issuance of a Purchase Order to the Contractor to perform repair services of the large water pump, in an amount not to exceed $48,000.00; and WHEREAS, February 12, 2021, authorized the issuance of a second purchase order to the Contractor, in an amount not to exceed in an amount not to exceed $27,495.00, for repair services for the second, smaller water pump that was in need of emergency repairs; and WHEREAS, the City Commission now wishes to ratify the issuance of purchase orders to the Contractor to perform repair services to the Pump Station, in an amount not to exceed Seventy -Five Thousand Four Hundred Ninety -Five Dollars ($75,495.00), attached hereto as Exhibit "A".
