RESOLUTION NO. 2021 - 3 I72 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, RATIFYING THE ISSUANCE OF <br />PURCHASE ORDERS TO MWI CORPORATION, D/B/A MWI PUMPS, <br />TO PROVIDE REPAIR SERVICES TO THE GOLDEN SHORES <br />STORMWATER PUMP STATION, IN AN AMOUNT NOT TO EXCEED <br />SEVENTY-FIVE THOUSAND FOUR HUNDRED NINETY-FIVE <br />DOLLARS ($75,495.00); AUTHORIZING THE CITY MANAGER TO DO <br />ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, in 2020, the City experienced torrential downpours, causing severe <br />flooding in the Golden Shores neighborhood ("Golden Shores"); and <br />WHEREAS, the heavy rain caused an over exertion in the capacity of the water pumps <br />located in the Golden Shores Stormwater Pump Station ("Pump Station"); and <br />WHEREAS, city staff determined that the water pumps were in need of emergency <br />repairs ("Services") to ensure proper drainage of Golden Shores and its vicinity; and <br />WHEREAS, pursuant to section 62-13 (D) of the City's Code of Ordinances, the City <br />Manager determined that the risk of damage to private and public property, as well as to <br />infrastructure, that is caused by flooding, constitutes an emergency and necessitates immediate <br />action by the City, and therefore, does not permit adequate time to utilize the competitive <br />bidding process; and <br />WHEREAS, on or about November 2020, the City Manager instructed staff to conduct a <br />good faith review of available resources and negotiate a reasonable price with a qualified <br />contractor to provide the desired Services; and <br />WHEREAS, city staff determined that MWI Corporation, d/b/a MWI Pumps <br />("Contractor"), is qualified, willing, and able to perform the Services desired by the City; and <br />WHEREAS, on November 18, 2020, the City Manager authorized the issuance of a <br />Purchase Order to the Contractor to perform repair services of the large water pump, in an <br />amount not to exceed $48,000.00; and <br />WHEREAS, February 12, 2021, authorized the issuance of a second purchase order to <br />the Contractor, in an amount not to exceed in an amount not to exceed $27,495.00, for repair <br />services for the second, smaller water pump that was in need of emergency repairs; and <br />WHEREAS, the City Commission now wishes to ratify the issuance of purchase orders <br />to the Contractor to perform repair services to the Pump Station, in an amount not to exceed <br />Seventy -Five Thousand Four Hundred Ninety -Five Dollars ($75,495.00), attached hereto as <br />Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />R2021 Waive Bid Req & Issue PO To MWI Pumps For GS Pump Repairs Page 1 of 2 <br />
