RESOLUTION NO.2021 - IZ4 Z A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE REQUEST SUBMITTED BY 18401 DEVELOPERS, LLC. FOR A TEMPORARY SALES CENTER STRUCTURE LOCATED AT 18325 COLLINS AVE FOR THE PROJECT KNOWN AS THE BENTLEY RESIDENCES, SUBJECT TO CERTAIN CONDITIONS; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 265-14(B)(1)(d) of the Code of Ordinances of the City of Sunny Isles Beach ("City"), temporary sales centers established for the express purpose of marketing a real estate development projects require a temporary use or structure permit issued by the City; and WHEREAS, on or about June 16, 2021, 18401 Developers, LLC, the ("Applicant") submitted an application to the City requesting a temporary off -site sales center at 18325 Collins Avenue ("Property") for the project known as the Bentley Residences; and WHEREAS, pursuant to Resolution 2014-2354 adopted on December 18, 2014, the City Commission originally approved the Property as a temporary sales center for the Armani Casa project; and WHEREAS, pursuant to Resolution 2014-2354, Section 3.(4), the removal of the structure serving as a temporary sales center was to be removed no later than 30 days from the issuance of the temporary certificate of occupancy of the Armani Casa project; and WHEREAS, the developer for the Armani Casa project requested an extension of time for the removal of the temporary sales center, which was granted, therefore, the structure remains on the Property; and WHEREAS, the Applicant now wishes to renovate and utilize the existing structure as a temporary off -site sales center for the Bentley Residences; and WHEREAS, the City Commission wishes to approve the Applicant's request to modify the temporary off -site sales center. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval. Pursuant to Sections 265-11 and 265-14 of the Code of Ordinances of the City of Sunny Isles Beach, the City Commission hereby approves the application submitted by the Applicant, subject to the conditions set forth herein. Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Conditions.
