I <br /> C. Purchases in excess of$25,000.00. The City Commission shall approve all purchases of <br /> or contracts for materials, supplies, equipment, public improvements of services where <br /> the total amount to be expended is more than $25,000.00. Notwithstanding this <br /> provision, purchases in excess of $25,000.00 for utilities shall be administratively <br /> approved in the adopted fiscal year budget and are not subject to the requirements of <br /> Chapter 62 of the Code unless required by the City Commission. For purposes of this <br /> exemption, the term "utilities" shall include electrical, water, natural gas (excluding <br /> fuel/diesel purchases), sewage and solid waste collection, and telecommunication <br /> services including but not limited to cable television, telephone lines, internet <br /> connectivity, data and voice circuits, voice over internet protocol ("VOIP"), <br /> cellular/wireless phones, wide area network ("WAN") connectivity, pagers, and wireless <br /> adapters for cellular data("air cards"). <br /> § 62-13. Exemptions from competitive bidding. <br /> The following shall be exempt from the competitive bidding procedures outlined in this chapter. <br /> G. Exempt contractual services and products. Other exempt contractual services and <br /> products not subject to the competitive procurement requirements of this Code are listed <br /> as follows: <br /> (5) Utilities, including but not limited to, electric, water, natural gas (excluding <br /> � ) g g g <br /> fuel/diesel purchases), sewage and solid waste collection, and telecommunication <br /> services including but not limited to cable television, telephone lines, internet <br /> connectivity, data and voice circuits, voice over internet protocol ("VOIP"), <br /> cellular/wireless phones, wide area network ("WAN") connectivity, pagers, and <br /> wireless adapters for cellular data("air cards"). and tele"hone . <br /> Section 3. Severability. The provisions of this Ordinance are declared to be severable and if <br /> any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br /> or unconstitutional, such decision shall not affect the validity of the remaining sections, <br /> sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the <br /> legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> Section 4. Inclusion in the Code. It is the intention of the Commission, and it is hereby <br /> ordained, that the provisions of this Ordinance shall become and be made a part of the code of the <br /> City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or <br /> relettered to accomplish such intentions; and that the word "ordinance" shall be changed to <br /> "section"or other appropriate word, as required. <br /> Words added underlined,words stricken deleted(ed) Page 2 of 3 <br />
