<br />01310 - 6/6 <br />Recovery plans that require a change in the Construction Contract Schedule must be <br />submitted as a Revision in accordance with this specification. <br />C. The CONTRACTOR’S refusal, failure or neglect to take appropriate recovery action <br />or to submit a written recovery statement shall constitute reasonable evidence that <br />the CONTRACTOR is not prosecuting the WORK, or separable part, with the <br />diligence that will ensure its completion within the Contract Time. Such lack of action <br />shall constitute sufficient basis for the CITY to recommend the withholding of some <br />or all of any payment due and/or shall be considered grounds for termination of the <br />contract by the CITY in accordance with Article 15 of the General Condition. <br /> <br />END OF SECTION <br />
