WHEREAS, the City has held all duly required public hearings, both prior to submission of the proposed amendment of the plan to the State Department of Economic Opportunity and after the proposed amendment of the plan was returned to the City, in accordance with Chapter 163.3184, Florida Statutes; and WHEREAS. the City Commission desires to adopt the updated Work Plan along with amendments to the current comprehensive plan to guide and control the future development of the City and to preserve, promote and protect the public health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof. Section 2. Amendments to the Comprehensive Plan. The City hereby adopts the The Report - Based Amendments to the 10 -year Water Supply Facilities Work Plan Update attached hereto and incorporated herein as Exhibit "A". The City of Sunny Isles Beach Comprehensive Plan is hereby amended by adopting the water supply related amendments to its current Comprehensive Plan, which amendments are attached as Exhibit "AB" to this Ordinance and made part hereof. and a -,.,a Rt5 to be pre -,,,,-„a to the r.,,paFt..,,,,,+ Section 3. Transmittal. The City Manager or designee is hereby directed to transmit the updates to the 10 Year Water Supply Plan Update along with amendments to the current comprehensive plan, in accordance with Section 163.3184(7), Florida Statutes. Section 4. Repealer. All ordinances, or parts of ordinances in conflict herewith be, and the same, are hereby repealed. Section 5. Severability. If any section, subsection, clause or provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not be affected by such invalidity. Section 6. Effective Date. If the amendment is timely challenged, this amendment shall become effective on the date the state land planning agency or the Administration Commission enters a final order determining this adopted amendment to be in compliance.
