Plans are subject <br />to modification. <br />2. Upon the submittal of an application for a building permit, the plans submitted shall <br />be approved by the Development Services Department and be consistent with the <br />specific site plan approved by the City Commission. Plans shall include all the required <br />elements of the site plan pursuant to the City's Land Development Regulations and <br />recommendations. Should compliance with recommendations result in a change that <br />would not be considered "minor" in accordance with Section § 265-18 of the City <br />Code; the Applicant shall be required to obtain a site pan modification approval of the <br />City Commission. <br />3. That a plot plan be submitted to the Development Services Department for <br />review. The plot plan shall include all easements proffered by the Applicant to the <br />City, including but not limited to (i) a minimum of ten -foot (10') landscape easement <br />along the west side of the property, (ii) one (1) bus shelter easement and relocation, <br />(iii) a 10,000 square foot Public Oceanfront Park easement and (iv) a 20 -foot beach <br />access easement. The plot plan shall show, but is not limited to, the type and size of <br />plant materials, lighting, and City approved furniture, signage, paver design <br />specification and maintenance. <br />4. That the Applicant submit a Declaration of Restrictions in recordable form acceptable <br />to the Development Services Department and acceptable to the City Attorney prior <br />to submittal for an application for building permit, which proffers: (i) a minimum of <br />ten -foot (10') landscape easement along the west side of the property and (ii) one (1) <br />bus shelter easement and (iii) a 10,000 square foot Public Oceanfront Park easement <br />and (iv) a 20 -foot beach access easement. Additionally, the Declaration shall provide <br />that the Applicant (v) provide 24-hour valet parking services for owners and guests <br />and (vi) include that the ownership assignment of any cabana shall be strictly to an <br />owner or owners of a unit within the Bentley Residences project. Cabanas shall not be <br />used as a dwelling unit and shall not be rented or leased to any person other than an <br />owner or owners of a unit within the condominium. The maintenance of these <br />easements, parking areas and cabanas shall be the responsibility of the Applicant. <br />5. That the Applicant submit a Declaration of Restrictive Covenants in recordable form <br />acceptable to the Development Services Department and acceptable to the City <br />Attorney prior to submittal for an application for building permit for the subdivision <br />of the property. <br />6. That the Applicant complies with all conditions and permit requirements, including <br />but not limited to, Miami -Dade County DERM, environmental conditions and <br />permitting, the Fire and Water and Sewer Departments, and Florida Department of <br />Transportation (FDOT), Miami -Dade DTPW, Miami -Dade Aviation, Florida Department <br />of Environmental Protection (FDEP), etc. <br />ZR21 Bentley Site Plan Approval Page 5 of 12 <br />
