Contract Clauses for Solicitation 47QSMD20R0001 Refresh Number 9 Contract Number: GS-07F-0031W <br />(End of clause) <br />Note: Regulation 52.223-99 <br />The Government will take no action to enforce the clause implementing requirements of <br />Executive Order 14042, absent further written notice from the agency, where the place of <br />performance identified in the contract is in a U.S. state or outlying area subject to a court <br />order prohibiting the application of requirements pursuant to the Executive Order <br />(hereinafter, Excluded State or Outlying Area). In all other circumstances, the Government <br />will enforce the clause, except for contractor employees who perform substantial work on <br />or in connection with a covered contract in an Excluded State or Outlying Area, or in a <br />covered contractor workplace located in an Excluded State or Outlying Area. A current list <br />of such Excluded States and Outlying Areas is maintained at <br />https://www.saferfederalworkforce.gov/contractors/. <br />552.252-6 AUTHORIZED DEVIATIONS IN CLAUSES (NOV 2021) <br />(DEVIATION FAR 52.252-6) <br />(a) Deviations to EAR clauses. This solicitation or contract identifies any authorized deviation to a <br />Federal Acquisition Regulation (FAR) (48 CER chapter 1) clause by the addition of "(DEVIATION <br />FAR (clause number))" after the date of the clause. <br />(b) Deviations to GSAR clauses. This solicitation or contract identifies any authorized deviation to a <br />General Services Administration Acquisition Regulation (GSAR) (48 CFR chapter 5) clause by the <br />addition of "(DEVIATION)" after the date of the clause. <br />(c) "Substantially the same as" clauses. Changes in wording of clauses prescribed for use on a <br />"substantially the same as" basis are not considered deviations. <br />(End of Clause) <br />52.219-3 NOTICE OF HUBZONE SET -ASIDE OR SOLE SOURCE <br />AWARD (SEP 2021) <br />(a) Definitions. HUBZone small business concern, as used in this clause, means a small business <br />concern, certified by the Small Business Administration (SBA), that appears on the List of Qualified <br />HUBZone Small Business Concerns maintained by the SBA (13 CFR 120.1031. <br />(b) Applicability. This clause applies only to- <br />(1) Contracts that have been set aside or awarded on a sole -source basis to, HUBZone small <br />business concerns; <br />(2) Part or parts of a multiple -award contract that have been set aside for HUBZone small <br />business concerns; <br />(3) Orders set aside for HUBZone small business concerns under multiple -award contracts as <br />described in 8.405-5 and 16.505(b)(2)(i)(F); and <br />(4) Orders issued directly to HUBZone small business concerns under multiple -award contracts <br />as described in 19.504(c)(1)(ii). <br />Page: 172 of 211 <br />
