WHEREAS, on March 15, 2022, the Mayor and City Commission sitting as the Local <br />Planning Agency ("LPA") at a properly advertised hearing received testimony and evidence <br />related to the amendment from stakeholders found that the small-scale comprehensive plan <br />amendment to the Comprehensive FLUM is consistent with the City's Comprehensive Plan and <br />provisions of Sec. 163.3187 Florida Statutes; and <br />WHEREAS, after careful review of the application, staff has determined that this <br />Application is in compliance with the City's Comprehensive Plan and consistent with Sec. <br />163.3187 of the Florida Statutes; and <br />WHEREAS, the City Commission has reviewed the City staff's report, incorporated herein, <br />which contains data and analysis supporting the FLUM amendment; and <br />WHEREAS, the City Commission finds that the proposed FLUM amendment is consistent <br />with the City's Comprehensive Plan and Land Development Code. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS:` <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part of this Ordinance <br />upon adoption hereof. <br />Section 2. Small -Scale Amendment to the Future Land Use Map. The City of Sunny Isles <br />Beach Future Land Use Map is hereby amended as follows: <br />The land use designation in the Future Land Use Map for the property located at 215 185 <br />Street, Sunny Isles Beach, Florida 33160, as legally described in Exhibit "A", and graphically <br />depicted in Exhibit "B", attached hereto and made a part thereof, is changed from "R-TH <br />Moderate Density Townhouse Residential" to "Community Facilities." <br />Section 3. Repealer. All ordinances, or parts of ordinances in conflict herewith be, and the <br />same, are hereby repealed. <br />Section 4. Severability. If any section, subsection, clause or provision of this Ordinance is <br />declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not <br />be affected by such invalidity. <br />Section 5. Transmitta. The City Manager or designee is hereby directed to transmit the City <br />of Sunny Isles Beach Draft Future Land Use Map Amendments to the State of Florida Department <br />of Economic Opportunity in accordance with Section 163.3187, Florida Statute, together with the <br />Memorandum prepared by The Corradino Group. <br />1 Additions to existing text are shown by underline, changes to existing text on second reading are shown by <br />double underline, and deletions are shown as strik g,"T <br />@BCL@FC0EIFAA.docx Page 2 of 3 98 <br />
