ORDINANCE NO. 2022 <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AMENDING THE CITY OF SUNNY ISLES BEACH LAND DEVELOPMENT <br />REGULATIONS (LDRs) OFFICIAL ZONING MAP FOR THE PROPERTY LOCATED AT <br />215 185 ST, SUNNY ISLES BEACH, FL 33160, TO AMEND THE ZONING DISTRICT <br />FROM MODERATE DENSITY TOWNHOUSE RESIDENTIAL (R-TH) TO COMMUNITY <br />FACILITIES PURSUANT TO CODE SECTION 265-4 OF THE CITY OF SUNNY ISLES <br />BEACH; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING <br />FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach ("City") has proposed a small-scale amendment <br />to the City's Future Land Use Map ("FLUM") for the property located at 215 185th Street, Sunny <br />Isles Beach, Florida, and as legally described in Exhibit "A" (the "Property") from Low to Moderate <br />Density Residential to Community Facility; and <br />WHEREAS, the City is in need of amending its Official Zoning Map to be consistent with its <br />FLUM, by amending the zoning district for the Property from "R-TH Moderate Density Townhouse <br />Residential" to "Community Facilities"; and <br />WHEREAS, on March 15, 2022, the Mayor and City Commission, sitting as the Local <br />Planning Agency ("LPA") at a properly advertised hearing received testimony and evidence <br />related to the amendment from stakeholders, found that the proposed amendment to the City's <br />Official Zoning Map is consistent with the City's Comprehensive Plan; and <br />WHEREAS, after careful review of City staff's report, the City Commission finds that the <br />proposed amendment to the City's Official Zoning Map is consistent with the City's <br />Comprehensive Plan. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS:' <br />Section 1. Amendment. Pursuant to Section 265-4 of the City Code, the official zoning map <br />of the City of Sunny Isles Beach is hereby amended as described in Exhibit "B". <br />Section 2. Severability. The provisions of this Ordinance are declared to be severable and if <br />any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br />or unconstitutional, such decision shall not affect the validity of the remaining sections, <br />sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the <br />legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. <br />Section 3. Inclusion in the Code. It is the intention of the Commission, and it is hereby <br />ordained, that the provisions of this Ordinance shall become and be made a part of the code of <br />the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered <br />1 Additions to existing text are shown by underline, changes to existing text on second reading are shown by <br />double underline, and deletions are shown as strike. <br />@BCL@980B8278.docx Page 1 of 2 17 <br />
