RESOLUTION NO. 2022 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, WAIVING THE BIDDING REQUIREMENTS SET FORTH IN CHAPTER 62 <br />OF THE CITY CODE; APPROVING AN AGREEMENT WITH GRAVOIS ALUMINUM <br />BOATS LLC, d/b/a METAL SHARK, FOR THE PURCHASE OF A MARINE PATROL <br />VESSEL, IN AN AMOUNT NOT TO EXCEED THREE HUNDRED TEN THOUSAND SIX <br />HUNDRED SEVENTY-SEVEN DOLLARS AND THIRTY-NINE CENTS ($310,677.39), <br />ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE <br />SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, the City of Sunny Isles Beach ("City") is in need of a new marine patrol vessel <br />("Vessel") for the City's Police Department; and <br />WHEREAS, after performing its due diligence, City staff determined that there are a <br />limited amount of vendors that can build and deliver the Vessel according to the City's needs; <br />and <br />WHEREAS, Gravois Aluminum Boats, LLC, d/b/a Metal Shark ("Vendor") is a certified and <br />insured company with the necessary experience to build and deliver the Vessel; and <br />WHEREAS, the Vendor provides similar services to various agencies throughout the <br />State of Florida through GSA MAS Contract No. GS -07F -0362T ("GSA Contract"); and <br />WHEREAS, pursuant to the City's procurement code provisions, purchases made under <br />state, county or other governmental contracts, or competitive bids with other entities are <br />exempt from the City's competitive bidding procedures; and <br />WHEREAS, although most of the components for the Vessel will be purchased at <br />the rates set forth in the GSA Contract, the City desires to purchase custom parts that are <br />not included in the GSA Contract, in an amount not to exceed $8,011.40; and <br />WHEREAS, pursuant to Section 62-12 of the City's Purchasing Code, the City <br />Commission may authorize the waiver of competitive bidding procedures upon the City <br />Manager recommending that it is in the City's best interest to do so; and <br />WHEREAS, upon careful consideration, the City Manager finds that it is in the City's <br />best interest to waive the bidding requirements; and <br />WHEREAS, the City Commission wishes to waive the bidding requirements of Chapter 62 <br />of the City Code, and approve an Agreement with Gravois Aluminum Boats, LLC, d/b/a Metal <br />Shark, for the purchase of a new marine patrol vessel, with custom parts, in a total amount not <br />to exceed Three Hundred Ten Thousand Six Hundred Seventy -Seven Dollars and Thirty -Nine <br />Cents ($310,677.39), attached hereto as Exhibit "A". <br />@BCL@B8072ACF.doc Page 1 of 2 145 <br />
