SUNNY 1,, 04 tOm U AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND AECOM TECHNICAL SERVICES, INC. CONTRACT NO. 2022-7942 THIS CONTRACTUAL AGREEMENT (hereinafter referred to as the "Agreement") is made in duplicate, this J day of� L,2022, by and between the CITY OF SUNNY ISLES BEACH, Florida, (hereinafter referred to as "City"), and AECOM TECHNICAL SERVICES, INC, a corporation authorized to do business in the State of Florida (hereinafter referred to as "Consultant") whose Federal I.D. # is 95-2661922. RECITALS WHEREAS, the City is in need of Consultant to provide services for the completion of a Cultural and Community Services Master Plan ("Services"); and WHEREAS, Consultant is a certified and insured company with the necessary experience to provide the desired Services; and WHEREAS, the City of Miami issued Request for Qualifications ("RFQ") 501331 "Miscellaneous Management Advisory Consulting Services" and awarded an agreement to AECOM Technical Services, Inc. beginning March 7, 2016, for an initial five (5) year term, terminating on March 6, 2021, with the option to renew for two (2) additional two (2) year terms; and WHEREAS, on March 7, 2021, the City of Miami amended the above referenced agreement, exercising its first renewal term through March 6, 2023, to the Consultant; and WHEREAS, the City desires to enter into an agreement with Consultant, using the City of Miami's solicitation information, Consultant's response thereto, and the resulting contract and amendments to provide the Services described in Exhibit "A", attached hereto and made part hereof, subject to the terms and conditions contained herein; and WHEREAS, pursuant to the City's procurement code provisions, purchases made under state, county or other governmental contracts, or competitive bids with other entities are exempt from the City's competitive bidding procedures; and WHEREAS, the City wishes to contract with Consultant to provide the desired Services for a total amount not to exceed One Hundred Sixty -Five Thousand Dollars ($165,000.00), which amount represents ($149,795.00) for the Services as set forth in the Consultant's fee proposal attached hereto as Exhibit `B", and an additional Fifteen Thousand Two Hundred Five Dollars ($15,205.00) in contingency should additional services be needed. NOW THEREFORE, in consideration of the promises and the mutual covenants herein name, the parties agree as follows: TERMS 1. RECITALS.
