RESOLUTION NO. 2022 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE <br />FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE IMPLEMENTATION <br />OF AN E -CITATION MODULE AND RELATED EQUIPMENT, AND ADDITIONAL <br />COMPUTER SYSTEM SOFTWARE AND LICENSES, IN AN AMOUNT NOT TO EXCEED <br />ONE HUNDRED SIXTY-ONE THOUSAND FIVE HUNDRED FIFTY-FIVE DOLLARS AND <br />NINE CENTS ($161,555.09), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR <br />AN EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for the approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in <br />compliance with the aforementioned legal requirements for the implementation of e -citation <br />module and related equipment, and additional computer system software and licenses, in an <br />amount not to exceed One Hundred Sixty -One Thousand Five Hundred Fifty -Five Dollars and Nine <br />Cents ($161,555.09), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached <br />certification, the Chief of Police is hereby authorized to spend up to One Hundred Sixty -One <br />Thousand Five Hundred Fifty -Five Dollars and Nine Cents ($161,555.09), attached hereto as Exhibit <br />"A", from the established Department of Justice federal forfeitures account for the <br />implementation of an e -Citation module and related equipment, and additional computer system <br />software and licenses. <br />Section 2. Effective Date.
