RESOLUTION NO. 2022 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, RATIFYING THE EXPENDITURE OF PARTIAL FORFEITURE FUNDS FROM <br />THE DEPARTMENT OF JUSTICE ("DOJ") IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 1984 FOR A NEW CRIME SCENE <br />VEHICLE AND A SPACE ASSESSMENT FEASIBILITY STUDY, IN AN AMOUNT NOTTO <br />EXCEED ONE HUNDRED FIFTY-ONE THOUSAND FIFTY-THREE DOLLARS <br />($151,053.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for the approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted for ratification the expenditure of DOJ <br />forfeiture funds in compliance with the aforementioned legal requirements fora new crime scene <br />vehicle and a space assessment feasibility study, in an amount not to exceed One Hundred Fifty - <br />One Thousand Fifty -Three Dollars ($151,053.00), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Ratification of Expenditure of Partial Federally Forfeited Monies. Based on the <br />attached certification, the Chief of Police is hereby authorized to spend up to One Hundred Fifty - <br />One Thousand Fifty -Three Dollars ($151,053.00), attached hereto as Exhibit "A", from the <br />established Department of Justice federal forfeitures account for a new crime scene vehicle and a <br />space assessment feasibility study. <br />Section 2. Effective Date.
