RESOLUTION NO. 2022 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROLACT OF 1984TO EXPEND PARTIAL FORFEITURE <br />FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE <br />ACCOUNT, FOR NEW POLICE OFFICER HIRES, AUTOMATIC CARD READERS, <br />POLICING EQUIPMENT, AND COMMUNITY EVENTS, IN AN AMOUNT NOT TO <br />EXCEED TWO HUNDRED THIRTY-FIVE THOUSAND SEVEN HUNDRED DOLLARS <br />($235,700.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in <br />compliance with the aforementioned legal requirements for new police officer hires, automatic <br />card readers, policing equipment, and community events, in an amount not to exceed Two <br />Hundred Thirty -Five Thousand Seven Hundred Dollars ($235,700.00), attached hereto as Exhibit <br />„A„ <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached <br />certification, the Chief of Police is hereby authorized to spend up to Two Hundred Thirty -Five <br />Thousand Seven Hundred Dollars ($235,700.00), attached hereto as Exhibit "A", from the <br />established Department of Justice federal forfeitures account for new police officer hires, <br />automatic card readers, policing equipment, and community events, in an amount not to exceed <br />Two Hundred Thirty -Five Thousand Seven Hundred Dollars ($235,700.00). <br />Section 2. Effective Date.
