LPA RESOLUTION NO. 2022 - <br />A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE CITY OF SUNNY ISLES <br />BEACH, FLORIDA, RECOMMENDING ADOPTION OF AN AMENDMENT TO THE <br />CITY OF SUNNY ISLES BEACH COMPREHENSIVE PLAN TO CREATE RECREATION - <br />OPEN SPACE AND CONSERVATION FUTURE LAND USE CATEGORIES; DIRECTING <br />THE TRANSMITTAL OF THE AMENDMENT TO THE STATE LAND PLANNING <br />AGENCY AND OTHER REVIEW AGENCIES; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, Section 163.3177(6)(a)1., F.S., requires that all local governments comply <br />with the following: <br />Each future land use category must be defined in terms of uses included, and <br />must include standards to be followed in the control and distribution of <br />population densities and building and structure intensities. The proposed <br />distribution, location, and extent of the various categories of land use shall be <br />shown on a land use map or map series which shall be supplemented by goals, <br />policies, and measurable objectives. <br />WHEREAS, the City of Sunny Isles Beach Comprehensive Plan Future Land Use Element <br />does not include Recreation -Open Space or Conservation future land use category <br />designations within the Future Land Use Element, although both are included on the Future <br />Land Use Map (FLUM), and each has its own Element identifying goals, policies, and <br />measurable objectives; and <br />WHEREAS, the absence of Recreation -Open Space and Conservation future land use <br />category designations within the Future Land Use Element has been identified as an <br />inadvertent omission, and will now be corrected through this text -based amendment; and <br />WHEREAS, City Commission serves as the Local Planning Agency ("LPA"), and is required <br />to review any amendments to the City's Comprehensive Plan; and <br />WHEREAS, on October 20, 2022, at a properly advertised meeting of the LPA, the LPA <br />determined that it is in the best interest of the City and its residents to recommend adoption of <br />an amendment of the City's Comprehensive Plan to create a property rights element. <br />NOW, THEREFORE, BE IT RESOLVED BY THE LOCAL PLANNING AGENCY OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part of this Resolution <br />upon adoption hereof. <br />Section 2. Recommending Adoption of Amendments to Comprehensive Plan. The <br />Local Planning Agency of the City of Sunny Isles Beach hereby recommends adoption of an <br />amendment of the City's Comprehensive Plan to create Recreation -Open Space and <br />LPA RESOLUTION Page 1 of 2 <br />
