RESOLUTION NO. 2023 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE <br />FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE <br />ACCOUNT FOR THE PURCHASE OF FIREARMS FOR USE BY THE POLICE <br />DEPARTMENT, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FIFTY-ONE <br />THOUSAND SIX HUNDRED FORTY-FIVE DOLLARS AND NINETY-FIVE CENTS <br />($151,645.95), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in <br />compliance with the aforementioned legal requirements for the purchase of firearms, in an <br />amount not to exceed One Hundred Fifty -One Thousand Six Hundred Forty -Five Dollars and <br />Ninety -Five Cents ($151,645.95), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached <br />certification, attached hereto as Exhibit "A", the Chief of Police is hereby authorized to spend One <br />Hundred Fifty -One Thousand Six Hundred Forty -Five Dollars and Ninety -Five Cents ($151,645.95), <br />from the established Department of Justice federal forfeitures account for the purchase of <br />firearms. <br />Section 2. Effective Date.
