k9y 4 <br />47 <br />a ♦ f L C+�-� '+ <br />C, S7 <br />Ak QF SVS+ h� <br />City of Sunny Isles Beach <br />18070 Collins Avenue <br />Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 City Hall <br />(305) 949-3113 Fax <br />MEMORANDUM <br />TO: Honorable Mayor and City Commissioners <br />FROM: Jeniffer Viscarra, Commissioner <br />DATE: March 16, 2023 <br />RE: Strongly Oppose Senate Bill 682 & House Bill 671 - Revisions to Florida'! <br />Permit and Plan Review Statutes <br />RECOMMENDATION: <br />Presented for your consideration. <br />REASONS: <br />During the 2023 Florida Legislative Session, Senator Nick DiCeglie and Representative Tiffany Esposit <br />sponsored Senate Bill 682 and House Bill 671, respectively, providing for comprehensive revisions tc <br />Florida's building permit statutes, including but not limited to the following: <br />• Requiring a local jurisdiction to reduce the permit fee by 75% if an owner retains a private <br />provider; <br />• Reducing the time frame of when municipalities must provide written notice of receipt and any <br />other additional information that is required for a properly completed application to an <br />applicant; and <br />• Allow an application to be "deemed" approved if municipalities fail to meet any of the <br />timeframes. <br />Specifically, the proposed bills reduce the time local governments would have to approve or deny <br />building permits, in certain instances from 30 business days to 9 calendar days. In light of the <br />devastating tragedy of the Champlain Towers condominium collapse, building safety should be of <br />utmost importance, and adequate time should be provided to local governments to review building <br />plans. The proposed truncated timeframe for a permit review process could result in catastrophic <br />flaws in building designs being missed during reviews, leading to unsafe structures and conditions, and <br />serious safety issues. <br />Item Number: 10.K <br />
