NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS:' <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part of this Ordinance <br />upon adoption hereof. <br />Section 2. Amendment to Chapter 235 of the Sunny Isles Code of Ordinances. Chapter 235 <br />of the City Code is hereby amended to create a title for Article I, and to create an Article II, <br />entitled "Water Quality," and shall read as follows: <br />ARTICLE I. STORM WATER UTILITY SYSTEM <br />ARTICLE II. WATER QUALITY <br />§ 235-6- Title, Purpose, and Intent. <br />The article shall be titled "Water Quality." The purpose of this article is to safeguard persons, <br />protect property, and prevent damage to the environment and to the City's surface waters, <br />through the regulation of non-stormwater discharges and pollutants into the City's municipal <br />separate storm sewer system (MS4), and its connected waterbodies, to the maximum extent <br />practicable. <br />§ 235-7. - Definitions. <br />(A) The following words, terms, and phrases, when used in this article, shall have the meanings <br />ascribed to them in this section, except where the context clearly indicates a different <br />meaning. <br />(1) Best Management Practices ("BMP"). The measures, practices, prohibition of practices, <br />schedules or activities, general good housekeeping practices, maintenance procedures, <br />educational practices, and/or devices which are generally accepted within an industry <br />as being effective, to reduce erosion from occurring on a disturbed site, preventing <br />sedimentation from occurring on an adjacent property or within a waterway, or <br />preventing the discharge of pollutants directly or indirectly to stormwater, receiving <br />waters, or stormwater conveyance systems. <br />(2) Construction. The act of creating or maintaining stockpiles of soil or other material <br />which are erodible if exposed to water or wind and capable of generating dust; or, <br />developing or improving public or private land which involves the removal of surface <br />cover or disturbance of soils and includes clearing, grading, demolition, and excavation. <br />' Additions to existing text are shown by underline, changes to existing text on second reading <br />are shown by double underline, and deletions are shown as stFikethF9WgI4. <br />Page 2 of 12 <br />
