ORDINANCE 2023 - 60 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, REPEALING SECTION 74-8, TITLED "STANDING COMMITTEES; CHAIRPERSONS" OF THE CODE OF ORDINANCES OF THE CITY OF SUNNY ISLES BEACH AND CREATING A NEW SECTION 74-8, TITLED "ADVISORY BOARDS AND COMMITTEES" THEREBY ESTABLISING REGULATIONS AND PROCEDURES GOVERNING APPOINTIVE ADVISORY BOARDS AND COMMITTEES AND PROVIDING FOR UNIFORM ADVISORY BOARD AND COMMITTEE MEMBERSHIP REQUIREMENTS AND PROCEDURES; REPEALING SECTION 74-9, TITLED "CITY BOARDS AND AGENCIES"; PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND AN EFFECTIVE DATE. WHEREAS, it is the intent of the City Commission of the City of Sunny Isles Beach, Florida, to enact by ordinance, a comprehensive policy that applies to all advisory boards and committees in the City, the effect of which will be to create uniform policies and procedures for their operation; WHEREAS, in contrast, Section C-2.2 of the City's Charter, titled "Mayor and Vice Mayor" governs the creation and appointments of all "standing committees" which provides that the Mayor may create as many standing and special committees as deemed necessary, and shall appoint the Commissioners of all standing committees, as well as the chairperson and vice chairperson of each committee; and WHEREAS, as reflected in the aforementioned City Charter provision, a "standing committee" is comprised solely of City Commissioners, which is distinct from traditional advisory boards and committees, which are comprised of individuals appointed by the Mayor and Commission; and WHEREAS, to ensure clarification and clear delineation between the two types of committees, enacting a new Section 74-8 of the Code is required to establish and clarify that said section and the procedures and requirements set forth therein apply to advisory boards and committees, and not standing committees, as the term is utilized in the City Charter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:' Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Section 2. Repeal of Section 74-8.
