RESOLUTION NO. 2023- 3 5C) 9 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN AMENDMENT TO THE UNIFORM SIGN PLAN SUBMITTED BY 252 SUNNY ISLES BLVD CU2 LLC FOR THE ST. TROPEZ SHOPS LOCATED AT 150-250 SUNNY ISLES BLVD; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City adopted Ordinance No. 2006-244 on February 16, 2006, establishing a requirement for multi -tenant centers to submit a uniform sign plan for the approval of the City Commission; and WHEREAS, on April 20, 2017, the City Commission passed and adopted Resolution No. 2017-2687, attached hereto as Exhibit A, approving the uniform sign plan and fagade modification submitted by Shops at 163rd, LLC, for the St. Tropez Shops, located at 150-250 Sunny Isles Blvd ("Uniform Sign Plan"); and WHEREAS, 252 Sunny Isles Blvd CU2 LLC (the "Applicant") is seeking an amendment to the Uniform Sign Plan to include new tenant signage on the south fagade of the building and directional signage proximate to the baywalk; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Approval of Amendment to Uniform Sign Plan. The amendment to the Uniform Sign Plan, to include new tenant signage on the south facade of the building and directional signage proximate to the baywalk, attached hereto as Exhibit B, is hereby approved. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining potions of this Resolution. Section 5. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and are hereby repealed. Section 6. Effective Date. This Resolution shall become effective upon adoption. 222
