RESOLUTION NO. 2023- 3 5C) 9 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING AN AMENDMENT TO THE UNIFORM SIGN PLAN <br />SUBMITTED BY 252 SUNNY ISLES BLVD CU2 LLC FOR THE ST. TROPEZ SHOPS <br />LOCATED AT 150-250 SUNNY ISLES BLVD; PROVIDING THE CITY MANAGER WITH <br />THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City adopted Ordinance No. 2006-244 on February 16, 2006, establishing <br />a requirement for multi -tenant centers to submit a uniform sign plan for the approval of the City <br />Commission; and <br />WHEREAS, on April 20, 2017, the City Commission passed and adopted Resolution No. <br />2017-2687, attached hereto as Exhibit A, approving the uniform sign plan and fagade <br />modification submitted by Shops at 163rd, LLC, for the St. Tropez Shops, located at 150-250 Sunny <br />Isles Blvd ("Uniform Sign Plan"); and <br />WHEREAS, 252 Sunny Isles Blvd CU2 LLC (the "Applicant") is seeking an amendment to <br />the Uniform Sign Plan to include new tenant signage on the south fagade of the building and <br />directional signage proximate to the baywalk; <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, AS FOLLOWS: <br />Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and <br />confirmed as being true and the same are hereby made part of this Resolution. <br />Section 2. Approval of Amendment to Uniform Sign Plan. The amendment to the Uniform <br />Sign Plan, to include new tenant signage on the south facade of the building and directional <br />signage proximate to the baywalk, attached hereto as Exhibit B, is hereby approved. <br />Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all <br />things necessary to effectuate this Resolution. <br />Section 4. Severability. If any section, subsection, sentence, clause, phrase, or portion of this <br />Resolution is, for any reason, held invalid or unconstitutional by any Court of competent <br />jurisdiction, such portion shall be deemed a separate, distinct and independent provision and <br />such holding shall not affect the validity of the remaining potions of this Resolution. <br />Section 5. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and <br />are hereby repealed. <br />Section 6. Effective Date. This Resolution shall become effective upon adoption. <br />222 <br />
