RESOLUTION NO. 2023 - 9 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND FORFEITURE FUNDS <br />FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE PURCHASE OF TWO <br />MARINE PATROL VESSELS, AND REALTIME CRIME CENTER RELATED ELECTRONIC <br />SYSTEMS AND EQUIPMENT, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED <br />EIGHTY THOUSAND NINE HUNDRED THIRTY-FOUR DOLLARS AND NINETY-ONE <br />CENTS ($280,934.91), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for the approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, on April 12, 2022, via Resolution No. 2022-3311, the City Commission of the City <br />of Sunny Isles Beach ("City") authorized the expenditure of forfeiture funds from the Department <br />of Justice ("Forfeiture Funds") for the purchase of a marine patrol vessel, in an amount not to <br />exceed $311,330.09; and <br />WHEREAS, on May 19, 2022, via Resolution No. 2022-3321 ("Resolution"), the City <br />Commission approved an Agreement with Gravois Aluminum Boats, d/b/a Metal Shark ("Vendor") <br />to build an deliver a marine patrol vessel ("Vessel"), in an amount not to exceed $310,677.39; and <br />WHEREAS, after adoption of the Resolution, the Vendor notified City staff that due to <br />supply chain issues the manufacturer would be unable to build and deliver the Vessel; and <br />WHEREAS, on June 15th, 2023, via Resolution No. 2023- U10 , the City Commission <br />repealed the Resolution and approved the purchase of two (2) Vessels from Phoenix Trading Inc. <br />("Phoenix"), in an amount not to exceed $398,454.40; and <br />WHEREAS, the Chief of Police has submitted a request to expend Forfeiture Funds, in <br />compliance with aforementioned legal requirements, for the difference in the amount not to <br />exceed Eighty -Seven Thousand One Hundred Twenty -Four Dollars and Thirty -One Cents <br />($87,124.31) attached hereto as Exhibit "A"; and <br />WHEREAS, the Chief of Police has also submitted a request to expend Forfeiture Funds in <br />compliance with the aforementioned legal requirements for the purchase of a Real Time Crime <br />Center Related Electronic Systems and Equipment, in an amount not to exceed One Hundred <br />Ninety -Three Thousand Eight Hundred Ten Dollars and Sixty Cents ($193,810.60), attached hereto <br />@BCL@AC099E46.doc Page 1 of 2 231 <br />
