RESOLUTION NO. 2023 - ( 0 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, REPEALING RESOLUTION NO. 2022-3321; APPROVING THE PURCHASE <br />OF A TWO (2) POLICE VESSELS FROM PHOENIX TRADING INC., IN AN AMOUNT <br />NOT TO EXCEED THREE HUNDRED NINETY-EIGHT THOUSAND FOUR HUNDRED <br />FIFTY-FOUR DOLLARS AND FORTY CENTS ($398,454.40), ATTACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY <br />TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, on May 18, 2022, via Resolution No. 2022-3321, the City Commission of the <br />City of Sunny Isles Beach ("City") authorized the purchase of a police vessel ("Vessel") from <br />Gravois Aluminum Boats d/b/a Metal Shark ("Vendor"); and <br />WHEREAS, after adoption of the Resolution, the Vendor notified City staff that due to <br />supply chain issues the manufacturer would be unable to furnish the Vessel; and <br />WHEREAS, the City Commission wishes to repeal Resolution No. 2022-3321; and <br />WHEREAS, the City is still in need of purchasing police vessels to service the community; <br />and <br />WHEREAS, Phoenix Trading Inc. ("Phoenix") has advised City staff that it has a contract <br />under the General Services Administration Contract No. 47QMCA18DO06 ("GSA Contract"); and <br />WHEREAS, Phoenix is a certified and insured company with the necessary experience to <br />build and deliver the Vessel; and <br />WHEREAS, pursuant to the City's procurement code provisions, purchases made under <br />state, county or other governmental contracts, or competitive bids with other entities are <br />exempt from the City's competitive bidding procedures; and <br />WHEREAS, Phoenix has submitted a proposal to the City utilizing the pricing from the <br />GSA Contract for two (2) vessels; and <br />WHEREAS, the City Commission wishes to approve the purchase of two (2) police vessels <br />from Phoenix, in an amount not to exceed Three Hundred Ninety -Eight Thousand Four Hundred <br />Fifty -Four Dollars and Forty Cents ($398,454.40), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Repeal of Resolution No. 2022-3321. The City Commission hereby repeals <br />Resolution No. 2022-3321. <br />Section 2. Approval of Purchase. The City Commission hereby approves the purchase of a <br />two (2) police vessels from Phoenix Trading Inc., in an amount not to exceed Three Hundred <br />@BCL@BCOB64CB.Doc Page 1 of 2 236 <br />
