OStANY 1 <br />S(9 <br />* AGREEMENT BETWEEN THE CITY OF SUNNY ISLES <br />9F Dye. FLORA°''` BEACH AND PRESTIGE AUTO TRANSPORT <br />TOWING & RECOVERY, INC. <br />CONTRACT NO. 2023-6706 <br />THIS AGREEMENT, entered into this day of June, 2023, by and between <br />the CITY OF SUNNY ISLES BEACH (hereinafter referred to as "City") and PRESTIGE <br />AUTO TRANSPORT TOWING & RECOVERY, INC., a Florida for-profit corporation <br />(hereinafter referred to as "Contractor"), whose Federal I.D. # is 45-2595305. <br />RECITALS <br />WHEREAS, the City is in need of a contractor to provide towing services on a <br />month-to-month rotating basis, whereby the Contractor provides 24-hour towing services, 365 <br />days per year, for the City ("Services"); and <br />WHEREAS, the City issued a Request for Proposal, RFP No. 23-05-01, which was <br />titled "Towing Services;" seeking proposals for purposes of entering into an agreement with <br />two (2) or more successful proposers to provide towing services on a month-to-month rotating <br />basis, 24-hour towing services, 365 days per year, thereupon also supplying the City with <br />priority service; and <br />WHEREAS, upon evaluation, Contractor was one of two contractors determined to <br />have submitted the lowest responsible and responsive bid; and <br />WHEREAS, the City wishes to contract with Contractor to provide the Services as <br />more particularly described herein and in the Contract Documents; <br />NOW THEREFORE, in consideration of the premises and the mutual covenants herein <br />names, the parties agree as follows: <br />TERMS <br />1. RECITALS: The recitals set forth above are hereby incorporated into this Agreement <br />and made a part hereof. <br />2. THE CONTRACT DOCUMENTS. The Contract Documents consist of this <br />Agreement, as well as the terms and conditions of RFP No. 23-05-01, "Towing Services,", which <br />is specifically incorporated herein as Exhibit "A", as well as Contractor's response thereto, <br />which is incorporated herein as Exhibit `B" (hereinafter referred to as "Contract Documents"). <br />3. SERVICES: The Contractor agrees to perform those Services described in RFP No. 23- <br />05-01, and Contractor's response thereto, which are both expressly incorporated herein by <br />reference and made a part hereof, including but not limited to, the removal, impounding, and/or <br />storage of junk vehicles, abandoned vehicles, illegally parked vehicles, non- drivable vehicles at <br />accident scenes, the vehicles of prisoners arrested by the City of Sunny Isles Beach Police <br />Department, confiscated vehicles, or for any other reason that arises from the streets or other <br />
