RESOLUTION NO. 2023 -'�— <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, EXPRESSING SUPPORT FOR A NO -WAKE ZONE IN DUMBFOUNDLING <br />BAY; DIRECTING THE CITY MANAGER AND CITY ATTORNEY TO BEGIN THE <br />PROCESS OF SUBMITTING AN APPLICATION AND AN ORDINANCE FOR REVIEW <br />AND APPROVAL BY THE FLORIDA FISH AND WILDLIFE CONSERVATION <br />COMMISSION; DIRECTING THE CITY CLERK TO DISTRIBUTE COPIES OF THIS <br />RESOLUTION; AUTHORIZING THE CITY MANAGER AND THE CITY ATTORNEY TO <br />DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the Intracoastal Waterway system ("ICW") is an inland waterway that runs <br />along the Atlantic Seaboard; and <br />WHEREAS, the IWC has a body of water located on the Atlantic Coast of South Florida <br />known as Biscayne Bay; and <br />WHEREAS, Biscayne Bay has a portion of its body of water located within the <br />boundaries of the City of Sunny Isles Beach ("City") known as Dumbfoundling Bay ("DFB"); and <br />WHEREAS, DFB is an integral part of the natural ecosystem and serves as a recreational <br />hub for boating, fishing, and other water activities; and <br />WHEREAS, the area has seen a significant increase in boating and recreational water <br />activities, causing considerable disruption to the marine environment; and <br />WHEREAS, excessive wakes have may cause boating accidents, property damage, and <br />jeopardize the safety of swimmers, kayakers, and paddle boarders; and <br />WHEREAS, the Florida Fish and Wildlife Conservation Commission ("FWC") has <br />jurisdiction over DFB; and <br />WHEREAS, based on the aforementioned, the City Commission finds that it is in the best <br />interest of the City, its residents, and visitors to establish a no -wake zone in DFB, from the <br />northern limits of the City, south to 183rd Street ("Targeted Area"); and <br />WHEREAS, the City Commission directs the City Manager and City Attorney to begin the <br />process of submitting an application and drafting an ordinance for review and approval by FWC <br />to establish a no -wake zone in the Targeted Area. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNY ISLES <br />BEACH, FLORIDA: <br />Section 1. Directive to the City Manager.
