<br /> <br />11 <br /> <br />CITY OF SUNNY ISLES BEACH <br />18070 Collins Ave. | Sunny Isles Beach, FL 33160 <br />305.792.1707 | sibfl.net | Purchasing@sibfl.net <br /> <br />2.5 CONTRACT TERM <br /> <br />This contract will commence upon execution by both parties which shall be the effective date <br />succeeding approval of the contract by the City Commission, or City Manager, unless otherwise <br />stipulated in the Notice of Award letter; and contingent upon the completion and submittal of all <br />required proposal documents. The successful Contractor will be awarded a contract for three (3) <br />years with the option to renew the contract for one (1) additional two (2) year period, for a total <br />of five (5) years. <br /> <br />Prior to completion of each exercised contract term, the City may consider an adjustment to price <br />based on changes in the following pricing index: Consumer Price Index (CPI), All Urban Consumers, <br />All Items, Miami-Ft. Lauderdale area, in an amount not to exceed 5%. <br /> <br />2.6 METHOD OF AWARD <br /> <br />The term “lowest responsible and responsive Bidder” as used herein shall mean the Bidder whose <br />bid is the lowest of those Bidders possessing the skill, ability, and integrity necessary for the <br />faithful performance of the work, whose bid best serves the interests of and represents the best <br />value to the City, as determined by the City Commission and/or the City Manager. The bidder will <br />also be evaluated as part of their “responsibleness” on their quality control plan and safety plan. <br /> <br />The City Manager may also reject all proposals received. Section 62-8 of the City Code provides <br />that the City may consider the following when evaluating bid submissions: <br /> <br /> The ability, capacity, and skill of the vendor to perform the Contract. <br /> The character, integrity, reputation, judgment, experience, and efficiency of the vendor. <br /> The quality of performance of previous contracts with the City and references. <br /> <br />The City also reserves the right to waive minor variations to specifications (interpretation of minor <br />variations will be made by applicable City Procurement personnel). In addition, the City reserves <br />the right to cancel any contract by giving thirty (30) days written notice. The City reserves the right <br />to negotiate the type and cost of specific types of services to be purchased. <br /> <br />2.7 MULTIPLE AWARD <br /> <br />The City may award multiple Contractors, as available, by line item, or by group. It is the intent of <br />the City to award a Primary Contractor that services “Group 1” and “Group 2”, however the City <br />reserves the right to award “Group 1” and “Group 2” to multiple contractors as primary and <br />Secondary Contractor for services to be provided to the City under this ITB. The Primary <br />Contractor shall be the initial firm mobilized by the City. The Secondary Contractor will be utilized <br />in instances where the scope of the event merits additional resources to assist the Primary <br />Contractor, or if the Primary Contractor has defaulted its contract. However, the City may utilize <br />other Bidders in the event that: 1) a contract Bidder is not or is unable to be in compliance with <br />any contract or delivery requirement; 2) it is in the best interest of the City to do so regardless of <br />reason.
