RESOLUTION NO. 2023 - -� A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RESCINDING RESOLUTION NO. 2022-3415; AUTHORIZING THE EXPENDITURE OF BUDGETED FUNDS FOR THE PURCHASE OF FIVE (5) TOYOTA RAV4 LE HYBRID VEHICLES FROM SEMINOLE TOYOTA, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FORTY-NINE THOUSAND ONE HUNDRED THIRTY DOLLARS AND NO CENTS ($149,130.00); AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 20th, 2022, via Resolution No. 2022-3415, the City Commission of the City of Sunny Isles Beach ("City") authorized the expenditure of budgeted funds for the purchase of vehicles for use by the City's Building Department ("Building"); and WHEREAS, due to supply chain issues and national vehicle shortages, Building was unable to purchase the vehicles during Fiscal Year 2022-2023; and WHEREAS, on September 14, 2023, via Ordinance No. 2023-606, the City Commission of the City of Sunny Isles Beach ("City") adopted the Operating and Capital Improvement Budget for the Fiscal Year Commencing October 1, 2023, through September 30, 2024 ("Adopted Budget"); and WHEREAS, Building continues to have the need of purchasing three (3) vehicles to continue offering high levels of service to City residents and stakeholders; and WHEREAS, the City's Code Compliance Division is also in need of purchasing two (2) vehicles for use by their officers; and WHEREAS, pursuant to Section 62-13(C) of the City's Purchasing Code, purchases made under state general service administration contracts, federal, county or other governmental contracts or competitive bids with other governmental agencies, are exempt from the competitive bidding requirements set forth in Chapter 62; and WHEREAS, City staff has been able to secure five (5) Toyota RAV4 LE Hybrid Vehicles (the "RAV4s") from Seminole Toyota (the "Vendor") utilizing the Florida Sheriff's Association Light Vehicle Contract No. FSA23-TOY1.0: TOYOTA; and WHEREAS, the purchase of these Vehicles were included in the Adopted Budget; and WHEREAS, the City Commission wishes to authorize the City Manager, or his designee, to expend budgeted funds for the purchase of the RAV4s from the Vendor, in an amount not to exceed One Hundred Forty -Nine Thousand One Hundred Thirty Dollars and No Cents ($149,130.00), attached hereto as Exhibit "A".
