Mutual Aid Agreement- Burglary Apprehension and Vehicle Crimes Unit Task Force <br />6.3 A political subdivision that furnishes equipment pursuant to this Agreement must <br />bear the cost of loss or damage to that equipment and must pay any expense incurred <br />in the operation and maintenance of that equipment. <br />6.4 The Assisting Agency will pay the salary, benefits, overtime and other <br />compensation to its Officers assigned to the task force, including any amounts paid or <br />due for compensation due to personal injury or death while such Officer is engaged in <br />rendering such assistance. <br />6.5 The privileges and immunities from liability, exemption from laws, ordinances and <br />rules, and all pension, insurance, relief, disability, worker's compensation, salary, death <br />and other benefits that apply to the activity of an employee of an agency when <br />performing the employee's duties within the territorial limits of the employee's agency <br />apply to the employee to the same degree, manner, and extent while engaged in the <br />performance of the employee's duties extraterritorially under the provisions of this <br />Agreement. The provisions of this section shall apply with equal effect to paid, <br />volunteer, and reserve employees. <br />SECTION 7: FORFEITURE <br />7.1 The Assisting Agency in whose jurisdiction property is seized will maintain the <br />seized property and determine whether there is a good -faith basis to initiate forfeiture <br />proceedings related to property seized by it in the course of the task force investigations <br />relating to this Agreement. <br />7.2 In cases of overlapping jurisdiction between a County Assisting Agency and a <br />Municipality Assisting Agency, the municipality shall be responsible for any forfeiture of <br />seized property in accordance with Section 7.1, unless otherwise agreed to by the <br />municipality and the county. <br />7.3 It is recognized that during the course of the operation of this Agreement, <br />property subject to forfeiture under the Florida Contraband Forfeiture Act, Section <br />932.701, et. seq., Florida Statutes, may be seized. Any such property seized, and if <br />forfeited and awarded, shall be equitably distributed among the participating agencies in <br />proportion to the amount of investigation and participation performed by each agency, <br />less the costs associated with the forfeiture action. The agency pursuing the forfeiture <br />action shall have the exclusive right to control and the responsibility to maintain the <br />property including, but not limited to, the complete discretion to bring the action, to <br />dismiss the action, or to settle, pursuant to the provision of the Florida Contraband <br />Forfeiture Act. <br />SECTION 8: INSURANCE <br />8.1 Each party shall provide satisfactory proof of liability insurance by one or more of <br />the means specified in Section 768.28(16), Florida Statutes, in an amount which is, in <br />the judgment of the governing body of that party, at least adequate to cover the risk to <br />which that party may be exposed.
