RESOLUTION NO. 2024 - �3 Q <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, EXPRESSING SUPPORT OF FLORIDA SENATE BILL 1178 RELATING TO <br />GOVERNANCE OF CONDOMINIUM AND COOPERATIVE ASSOCIATIONS AND THE <br />PRACTICE OF COMMUNITY ASSOCIATION MANAGEMENT; DIRECTING THE CITY <br />CLERK TO TRANSMIT COPIES OF THIS RESOLUTION; AUTHORIZING THE CITY <br />MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; <br />PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") recognizes the critical role that <br />condominium and homeowners associations play in the governance and operation of community <br />living spaces, contributing to the overall quality of life for its residents; and <br />WHEREAS, State Senators Jennifer Bradley and Jason Pizzo have introduced Senate Bill <br />1178 (the "Bill"), a bipartisan effort aimed at enhancing the oversight and enforcement <br />capabilities of the Florida Department of Business and Professional Regulation ("DBPR") over <br />condominium and homeowners associations; and <br />WHEREAS, the Bill mandates the DBPR to perform random audits of community <br />associations to ensure compliance with official records management and website/application <br />processes, thereby increasing transparency and accountability in community governance; and <br />WHEREAS, the Bill requires all newly elected community association board members to <br />complete a standardized course in association law and continuing education, ensuring that board <br />members are well-informed and equipped to govern effectively; and <br />WHEREAS, the Bill aims to establish stricter conflict of interest disclosures for property <br />management firms and their employees, along with harsher penalties for fraudulent voting <br />activities, thereby fostering integrity and fairness in association elections and contract dealings; <br />and <br />WHEREAS, the Bill introduces reforms to allow condominium associations to meet their <br />obligations for records requests through website postings, change reserve requirements for <br />buildings deemed unsafe/uninhabitable, and permit the creation of investment committees to <br />invest reserve funds, enabling better financial management and safety compliance; and <br />WHEREAS, the City Commission finds that it is in the best interest of its residents to <br />support the Bill. <br />NOW, THEREFORE, BE RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1.
