BILL: CS/SB 1178 <br />Page 9 <br />stockholder or member of a cooperative apartment corporation who is entitled, solely by reason <br />of ownership of stock or membership in the corporation, to occupy an apartment in a building <br />owned by the corporation. 20 The cooperative holds the legal title to the unit and all common <br />elements. The cooperative association may assess costs for the maintenance of common <br />expenses. 21 There are 778 cooperative associations in Florida that are registered with the <br />DBPR.a2 <br />Miami -Dade County Grand Jury Report "Addressing Condo Owners' Pleas for Help: <br />Recommendations for Legislative Action" <br />The increasing numbers of condominiums in Florida, the increasing numbers of problems for <br />people living in them, and the increasing numbers of complaints against the DBPR, motivated a <br />Miami -Dade County grand jury to conduct an investigation of complaints by condominium <br />residents and the DBPR's responses to their complaints. 23 The grand jury's report contains <br />numerous findings and recommendations, but those relevant to the provisions of the bill are <br />discussed below. <br />Additional Issues <br />For ease of reference to each of the topics addressed in the bill, the Present Situation for each <br />topic will be described in Section III of this analysis, followed immediately by an associated <br />section detailing the Effect of Proposed Changes. <br />III. Effect of Proposed Changes: <br />Community Association Managers <br />Present Situation <br />Community Association Manager Regulation <br />Community association managers (CAMs) are licensed and regulated by the Department of <br />Business and Professional Regulation (DBPR or department) pursuant to part VIII of ch. 468, <br />F.S. <br />Section 468.431(2), F.S., defines "community association management" to mean: <br />any of the following practices requiring substantial specialized knowledge, <br />judgment, and managerial skill when done for remuneration and when the <br />association or associations served contain more than 10 units or have an annual <br />21 See Walters v.
