A subdivision of the state may agree to settle a claim <br />91 made or a judgment rendered against it in excess of the waiver <br />92 provided in paragraph (a) without further action by the <br />93 Legislature. <br />94 <br />95 However, bP..+t the state or"an agency or subdivision thereof shall <br />96 not be deemed to have waived any defense of sovereign immunity <br />97 or to have increased the limits of its liability as a result of <br />98 its obtaining insurance coverage for tortious acts in excess of <br />99 the $200,000 eLa $399, waiver provided in paragraph (a) . <br />100 However, a party may not lobby against any agreed upon <br />101 settlement brought to the Legislature as a settled claim bill <br />102 abe�e. An insurance policy may not condition the payment of <br />103 benefits, in whole or in part, on the enactment of a claim bill. <br />104 (c) The limitations of liability set forth in this <br />105 subsection shall apply to the state and its agencies and <br />106 subdivisions whether or not the state or its agencies or <br />107 subdivisions possessed sovereign immunity before July 1, 1974. <br />108 (d)+Ia* A municipality has a duty to allow the municipal law <br />109 enforcement agency to respond appropriately to protect persons <br />110 and property during a riot or an unlawful assembly based on the <br />111 availability of adequate equipment to its municipal law <br />112 enforcement officers and relevant state and federal laws.
