RESOLUTION NO. 2024 - 5-W <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, REQUESTING A WAIVER OF THE BIDDING REQUIREMENT SET FORTH <br />IN CHAPTER 62 OF THE CITY'S CODE OF ORDINANCES; APPROVING AN <br />AGREEMENT WITH STAN WEAVER AND COMPANY FOR THE PURCHASE AND <br />INSTALLATION OF EXHAUST FANS AT GATEWAY CENTER, IN AN AMOUNT NOT <br />TO EXCEED SEVENTY-NINE THOUSAND THREE HUNDRED SIXTY-EIGHT DOLLARS <br />AND SEVENTEEN CENTS ($79,368.17); AUTHORIZING THE MAYOR TO EXECUTE <br />SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS <br />NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR <br />AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") is the owner of the property located <br />at 151 Sunny Isles Boulevard, known as Gateway Center ("GWC"); and <br />WHEREAS, the City is in need of a contractor to furnish and install 4 energy efficient <br />exhaust fans in the kitchen of the GWC (the "Services"); and <br />WHEREAS, GWC is currently equipped with an exhaust fan system purchased from <br />Greenheck Fan Corporation ("GFC"); and <br />WHEREAS, GFC authorizes third party representative to sell their products and assigns <br />specific regions to each third party representative; and <br />WHEREAS, Stan Weaver & Company (the "Contractor") is the third -party representative <br />assigned to the Miami -Dade, Broward, and Monroe counties; and <br />WHEREAS, the Contractor is a certified and insured company, and has expressed the <br />ability and desire to provide the desired Services to the City; and <br />WHEREAS, pursuant to Section 62-12 of the City's Purchasing Code the City Commission <br />may authorize the waiver of competitive bidding procedures upon the City Manager <br />recommending that it is in the City's best interest to do so; and <br />WHEREAS, based on the need for continuity in service, the City Manager has <br />recommended the waiver of the competitive bidding requirements of Chapter 62 of the City's <br />Code of Ordinances; and <br />WHEREAS, the City Commission wishes to accept the City Manager's recommendation <br />to waive the bidding requirements of Chapter 62 of the City's Code of Ordinances and approve <br />an Agreement with the Contractor to provide the desired Services to the City, in an amount not <br />to exceed Seventy -Nine Thousand Three Hundred Sixty -Eight Dollars and Seventeen Cents <br />($79,368.17), which includes a ten (10%) contingency, attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />@BCL@ECOAAAA2.doc Page 1 of 2 <br />
