ORDINANCE 2024 - ` <br />AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A LEASE AGREEMENT BETWEEN THE CITY OF SUNNY ISLES <br />BEACH AND LA PLAYA BEACH ASSOCIATES, LLC. FOR THE LEASED PREMISES <br />LOCATED AT 18590 COLLINS AVENUE, SUNNY ISLES BEACH, FLORIDA; <br />AUTHORIZING THE MAYOR TO EXECUTE SAID LEASE AGREEMENT; PROVIDING <br />FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach, Florida, (the "City") is the owner of the land <br />located at 18590 Collins Avenue, Sunny Isles Beach, Florida ("Leased Premises"); and <br />WHEREAS, La Playa Beach Associates, LLC. ("Lessee") is a foreign limited liability <br />company organized under the laws of the State of Delaware; and <br />WHEREAS, the Lessee wishes to lease the Leased Premises for use as a temporary Sales <br />Center for the development of the property located at 18801 Collins Ave, Sunny Isles Beach, FL <br />33160, known as St. Regis Residences ("St. Regis"); and <br />WHEREAS, Section C-4.3 of the City's Charter, states that, "...acts of the City Commission <br />shall be by ordinance which ... (7) Convey or lease or authorize by administrative action the <br />conveyance or lease of any lands of the City;"; and <br />WHEREAS, in accordance to the aforementioned section of the City's Charter, the City <br />Commission wishes to approve a Lease Agreement between the City and the Lessee for the <br />Leased Premises for an initial term of forty-two (42) months, with five (5) one (1) year renewal <br />options at the City's sole discretion, attached hereto, in substantially the form, as Exhibit "A". <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS:' <br />Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br />and confirmed as being true and correct and are hereby made a specific part of this Ordinance <br />upon adoption hereof. <br />Section 2. Approval of Lease Agreement. In accordance with Section C-4.3 of the City's <br />Charter, the Lease Agreement between the City of Sunny Isles Beach and La Playa Beach <br />Associates, LLC. for the land located at 18590 Collins Avenue, Sunny Isles Beach, Florida, <br />attached hereto, in substantially the form, as Exhibit "A", is hereby approved. <br />Section 3. Effective Date.
