ORDINANCE 2024 - ` AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A LEASE AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND LA PLAYA BEACH ASSOCIATES, LLC. FOR THE LEASED PREMISES LOCATED AT 18590 COLLINS AVENUE, SUNNY ISLES BEACH, FLORIDA; AUTHORIZING THE MAYOR TO EXECUTE SAID LEASE AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach, Florida, (the "City") is the owner of the land located at 18590 Collins Avenue, Sunny Isles Beach, Florida ("Leased Premises"); and WHEREAS, La Playa Beach Associates, LLC. ("Lessee") is a foreign limited liability company organized under the laws of the State of Delaware; and WHEREAS, the Lessee wishes to lease the Leased Premises for use as a temporary Sales Center for the development of the property located at 18801 Collins Ave, Sunny Isles Beach, FL 33160, known as St. Regis Residences ("St. Regis"); and WHEREAS, Section C-4.3 of the City's Charter, states that, "...acts of the City Commission shall be by ordinance which ... (7) Convey or lease or authorize by administrative action the conveyance or lease of any lands of the City;"; and WHEREAS, in accordance to the aforementioned section of the City's Charter, the City Commission wishes to approve a Lease Agreement between the City and the Lessee for the Leased Premises for an initial term of forty-two (42) months, with five (5) one (1) year renewal options at the City's sole discretion, attached hereto, in substantially the form, as Exhibit "A". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:' Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Section 2. Approval of Lease Agreement. In accordance with Section C-4.3 of the City's Charter, the Lease Agreement between the City of Sunny Isles Beach and La Playa Beach Associates, LLC. for the land located at 18590 Collins Avenue, Sunny Isles Beach, Florida, attached hereto, in substantially the form, as Exhibit "A", is hereby approved. Section 3. Effective Date.
